SIT told not to arrest HDK till June 28

Bengaluru, Jun 21: The High Court of Karnataka on Tuesday extended its interim order directing the Special Investigation Team (SIT) probing illegal mining cases not to arrest former chief minister H D Kumaraswamy till June 28, the next date of hearing.

Special Public Prosecutor for the Lokayukta’s SIT P Govindan informed the court that they need to do custodial interrogation of Kumaraswamy in the Janthakal mining case. He said that the SIT would submit a case diary which has confidential information that requires Kumaraswamy’s custody.

Justice Rathnakala asked him if the offence committed is economic in nature, why the high court has to come in between the trial court proceedings. He said he will submit the case diary of the case in the next hearing and sought adjournment. The judge adjourned the next hearing to June 28.

Govindan said that Kumaraswamy used the office of the chief minister to pressure and influence an officer to pass certain orders. He said that Kumaraswamy had issued an ultimatum to accused IAS officer Gangaram Baderiya, who was then posted as director, Mines and Geology, to issue mining licence in two hours to Janthakal Enterprises, a company owned by mining baron Vinod Goel.

The SIT has registered a case against Kumaraswamy after he was named by Baderiya. He has been booked for cheating, forgery, criminal breach of trust and giving false information, criminal conspiracy under the IPC sections. Kumaraswamy has also been booked under the provisions of the Prevention of Corruption Act, 1988 and The Mines and Minerals (Development and Regulation) Act, 1957.

Kumaraswamy’s advocate Hashmath Pasha submitted that same allegations were made against his client in two other complaints. He said three separate complaints have been registered, of which one has been quashed by the high court. He contended that when Kumaraswamy was the chief minister, he had not pressured Baderiya to issue mining licence in favour of Goel.

He said iron ore was legally extracted since the Forest department denied permission to lift the ore that was mined. It is neither lifted nor sold and is still lying in the mining area of Chikkjajur in Chitradurga district.

Bengaluru: The National Investigation Agency (NIA) on Wednesday launched simultaneous raids in multiple places, including Bengaluru and Shivamogga.

Reports suggested that the ongoing raids are in connection with the Improvised Explosive Device (IED) blast in Bengaluru’s Rameshwaram Cafe on March 1. The blast had injured at least ten people as per the police report.

The Central Crime Branch (CCB) had launched an investigation alongside the NIA, and the trail of the suspect led them to Tumakuru first and subsequently to Ballari. Investigators believe that the bomb was planted by Mussavir Hussain Shazib, a handler of the Islamic State’s Shivamogga module who was aided by another IS handler called Ahmed Taahaa.

Sources in the know said that Shazib and Taahaa had stayed in Chennai for about a month between January and February using fake credentials. The names of the suspects were identified after they traced the cap worn by Shazib to a shop in a mall in Chennai. The cap, which was abandoned by the bomber in Bengaluru after the blast, was reportedly bought by Taahaa, around January-end.

As per the NIA, Shazib hails from Masjid Road in Thirthahalli, Shivamogga district, and Taahaa from Fish Market Road, Soppu Gude, Thirthahalli Rural. Both "wanted" suspects have been termed "absconders" by the NIA.

The NIA has questioned seven jailed terror suspects so far in connection with the blast. The investigation agency had also obtained seven-day custody of a jailed terror suspect named Maaz Muneer Ahmed.

Mangaluru: A man from Dakshina Kannada was duped of Rs 2.5 lakh after he was promised a Poland visa.

In a complaint, a resident of Belthangady, stated that the accused, Manoj, had promised a job for his son in Poland. 

Between May 22 of last year and March 19, he handed over Rs 2.2 lakh in various phases, citing different reasons.

However, since the accused failed to provide a visa or return the money, a case was registered at the Dharmasthala police station under IPC sections 417 and 420.

Mangaluru: In the wake of complaints regarding middlemen menace, sleuths of Lokayukta on Friday, March 15, conducted a raid at the Mangaluru Urban Development Authority. 

The Lokayukta team found unaccounted money and several files, which were not disposed of for a long period.

Lokayukta SP CA Simon said that the Lokayukta has received complaints that middlemen have been interfering in the MUDA office, and files pertaining to the public are not being cleared on time.

A raid that commenced in the evening on March 13, lasted for 18 hours. During the raid, Lokayukta officials found cash in a bag in MUDA office, and also with officials and others. MUDA officials could not inform the source of money found in their office, the SP said.

Further, he said that many people gathered at the MUDA office during the Lokayukta raid, and have raised complaints about the harassment at the urban development authority. “We have gathered evidence for MUDA officials carrying out file disposal processes through brokers on phone calls. The investigation on the MUDA network will be continued,” he said.
