Prove single charge of graft against me, I'll quit: Justice Subhash Adi

Bengaluru: Nov 25: Justice Subhash B Adi on Tuesday reacted sharply to the petition by Congress MLAs to the Speaker to move a motion to oust him as the Upalokayukta.

Justice Adi said his direction for investigation into corruption within the Lokayukta was the reason for former Upalokayukta Justice S B Majage to target him. “Let them produce one instance of me involved in corruption, I will resign. This situation is created only to destabilise this institution (Lokayukta). I will not let this institution perish as long as I am here,” he said.

Though it is not known what charges Congress MLAs have mentioned in the petition to the Speaker, Justice Adi reiterated that the enquiry report pertaining to one Dr Sheela Patil was placed before him by mistake, which was proved by an internal enquiry. He said based on an anonymous complaint, Justice Majage had directed a vigilance director of the Lokayukta to hold an enquiry against Dr Patil. The allegations were found to be baseless and the report was submitted to Upalokayukta Justice Majage on January 16, 2014.

The position of law
“The Lokayukta Act states that where two or more Upalokayuktas are appointed under the Act, the Lokayukta may, by general or special order, assign to each of them matters which may be investigated by them under the Act. However, it is an internal arrangement and the Act specifies that no investigation by the Upalokayukta can be questioned on the jurisdiction issue. With regard to Dr Patil’s case, since the file was placed before me, I just forwarded the report based on the one submitted by the enquiry officers. The government also accepted the report. Later, on February 24, 2014, Justice Majage ordered an internal enquiry to find out how the enquiry report was sent to me. The enquiry proved that it was forwarded to me by Majage’s office staff. Yet, he kept the internal enquiry report for more than a year, till his last day in office on July 17, 2015,” Justice Adi said.

He said that as per the Lokayukta Act, the senior-most Upalokayukta can only discharge the administrative duties of the Lokayukta in the absence of the latter. “Section 15 (4) of the Lokayukta Act only delegates administrative powers of the Lokayukta to the senior-most Upalokayukta. I cannot discharge the duties of the Lokayukta, such as clearing pending enquiries or passing orders against public servants who fall under the jurisdiction of the Lokayukta,” he said.

On the move by the Congress to oust him, Justice Adi said he was hurt and hoped that truth would prevail.

“All this started when a complaint was filed before me alleging inaction on the Lokayukta SP report about corruption within the Lokayukta. I had discussed this issue with Lokayukta Justice Y Bhaskar Rao and also with Justice S B Majage. Both ignored my concerns and Justice Majage, in fact, agreed to Justice Rao’s decision to hand over the case to CCB. I was in Mangaluru at that time and they took a decision. Since then, unseen forces have been trying to malign my image,” Justice Adi said.

Bengaluru, Apr 12: The two men who allegedly plotted and executed the blast that rocked Rameshwaram Cafe in Bengaluru last month have been arrested from Kanthi in Bengal's East Midnapore district, the National Investigation Agency said Friday morning. 

Mussavir Hussain Shazeb and Abdul Matheen Taha were caught after a joint operation by central intelligence agencies and police from Bengal, Karnataka, Telangana, and Kerala, and are en route to Kolkata, the anti-terror agency said in a statement.

The available evidence indicates Shazeb planted the explosive device, placed inside a backpack, at the popular eatery. Taha was responsible for planning the attack and for their disappearance.

These are the second and third arrests in this case; last month Muzammil Shareef, who extended logistical support to the Shazeb and Taha, was taken into custody.

Residents of Karnataka's Shivamogga district, Shazeb and Taha were traced to Kanthi after officials conducted searches at 18 locations across Karnataka, Tamil Nadu, and even Uttar Pradesh.

The blast at Bengaluru's Rameshwaram Cafe on March 1 injured 10 people, customers and staff.

Fortunately there were no deaths; the bag containing the explosives was placed in a relatively less crowded area and against a large pillar that absorbed the brunt of the explosion.

After the blast, the NIA released photos and videos of the accused, as seen on CCTV cameras across Bengaluru. In one such clip, the accused - wearing a face mask - was seen boarding a bus.

The agency had declared a reward of ₹ 10 lakh for information leading to the arrest of each accused. The agency had also questioned their acquaintances, including college and school friends.

The Rameshwaram Cafe, which suffered extensive damage after the blast, reopened eight days later, with enhanced security measures including metal detectors.

BJP’s reaction

The Karnataka BJP on Friday attacked the Siddaramaiah government after the arrest of two men by the NIA in the Bengaluru cafe blast case, saying that the terrorists were 'brothers' of the Congress.

Taking to social media, Karnataka BJP stated, “National Investigation Agency (NIA) detains ‘Brothers’ of Congress in Rameshwaram Blast case. Ever since Jihadi Tipu Sultan’s admirers came to power in Karnataka, terrorists have got a free ride.”

“Chief Minister Siddaramaiah’s ‘Ease of Doing Terror’ Policies have prompted ISIS to now set up its shop in Karnataka. The only guarantee that CM Siddaramaiah has fulfilled is converting prosperous Karnataka into a terror hub,” the BJP stated.

In a gut-wrenching tragedy, three high school boys drowned in the Tunga River in Tirthahalli town in Shivamogga district on April 1 evening.

Ayan, Samar, and Rafan, all aged around 16 years, had been to the Tunga River at Rama Mantap in the town after breaking the Ramadan fast (iftar) in the evening. 

All three were Class 10 students of a local high school and close friends.

Around 8 p.m., Tirthahalli police received information that the boys drowned.

With the help of local people, the bodies were retrieved from the river around 11 p.m. Hundreds of people gathered at the river bank. The bodies have been shifted to the government hospital in the town.

Tirthahalli Police have registered an unnatural death report.

Mangaluru/ Bengaluru, Apr 2: Karnataka’s coastal belt some of the neighbouring areas will celebrate Eid-ul-Fitr on April 10, while rest of the state will witness the festival on April 11 due confusion over moon sighting. 

Muslim religious heads in twin coastal districts of Dakshina Kannada and Udupi on the night of April 9 declared the end of Ramadan and beginning of Shawwal following reports of sighting of crescent moon. 

With this Eid will be celebrated on April 10 in the above region. Similarly, Muslims in Bhatkal and neighbouring state of Kerala too will celebrate the festival on April 10. 

However, Muslims in other parts of Karnataka will continue to fast on April 10 and celebrate the Eid on the following day due to non-sighting of moon in their region. 

The Karnataka Moon Sighting Committee chairman Moulana Maqsood Imran formally announced that the Eid-ul-Fitr in Bengaluru and areas of Karnataka will be celebrated on Thursday April 11.
