Modi’s Birthday overshadowed flood victims’ woes: Medha Patkar

Bhopal, Sept 18: Taking a dig at Prime Minister Narendra Modi and his supporters, social activist Medha Patkar who is leading the Narmada Bachao Andolan has said that Modi's birthday celebrations overshadowed the grief of those affected by the Sardar Sarovar Dam project.

Patkar has alleged that around 192 villages in three districts of Madhya Pradesh -- Dhar, Barwani and Alirajpur -- were marooned after the Gujarat government raised the water level of the Sardar Sarovar Dam to 138.68 metres.

"Prime Minister Modi's birthday has been celebrated like a festival, but the affected people are yet to be rehabilitated. The water level in the dam was raised ahead of its schedule as Modi's birthday falls on September 17," Patkar told IANS on Tuesday.

Patkar has alleged that the dam affected people have not been compensated despite the Supreme Court's direction. She said that the Madhya Pradesh government has claimed that it is yet to receive the compensation amount of Rs 1,857 crore from the Gujarat government.

Patkar blames the previous Shivraj Singh Chouhan's Bharatiya Janata Party (BJP) government for the problems of those affected by the dam.

She said: "Shivraj government claimed to have completed the rehabilitation programme and submitted a zero-balance affidavit which is not correct. This way they have snatched away the rightful that belonged to the affected families."

While attacking the Gujarat government for failing to fulfil the promises, she said: "The Rupani government had earlier said that the dam will be full by October 15, then he gave a new date of September 30, but how come the dam got filled just before Modi's birthday on September 17. It is clear now that for them Constitution does not mean anything. Thousands of people are getting drowned but for one person the dam was filled."

"Sardar Sarovar project is an interstate one, then why is Madhya Pradesh being discriminated. The Shivraj Singh government had surrendered before Modi and the Gujarat government. They never spoke the truth about their own states. Madhya Pradesh too had a share in the power generation, but the previous government kept mum," said Patkar.

She said that thousands were badly affected by the increased water levels in the dam. People in 192 villages were suffering so they observed Modi's birthday as 'dhikkar diwas'.

New Delhi, Mar 22: The Aam Aadmi Party has made it clear that Arvind Kejriwal will remain the Delhi Chief Minister despite his arrest in the liquor policy case. While no law would stop the AAP leader from running the state from prison, the jail guidelines would make it extremely difficult.

Kejriwal was arrested yesterday by the Directorate of Enforcement (ED), following his avoidance of nine summons issued by the investigative agency in relation to the Delhi liquor policy case. 

The decision to apprehend Kejriwal transpired shortly after the High Court's denial of protection from arrest. With this development, Kejriwal becomes the second opposition Chief Minister to face arrest by the ED within a span of fewer than two months, following Jharkhand Chief Minister Hemant Soren's similar fate in January 2024 due to allegations in a graft case. Subsequently, Hemant Soren was replaced by his party colleague, Champai Soren.

Delhi government minister Atishi declared shortly after Kejriwal's arrest that he would not step down from his position. However, the legality and feasibility of a detained Chief Minister continuing to fulfill official duties warrant examination.

A former law officer of Delhi's Tihar Jail says that an inmate can only hold two meetings in a week, which would make it difficult for Mr Kejriwal to carry out his responsibilities as Chief Minister.

Can he run government from prison?

While theoretically plausible, governing from detention presents logistical challenges. However, there exists no explicit prohibition against a Chief Minister conducting official responsibilities while under arrest. Disqualification only occurs upon conviction.

The Representation of the People Act, 1951 outlines disqualification provisions for specific offenses, necessitating a conviction for those holding office.

Will centre impose president’s rule?

Constitution expert SK Sharma told TOI that there exists no specific legal provision mandating the automatic resignation of a state's Chief Minister upon arrest. He cited the example of former Bihar CM Lalu Prasad Yadav, who appointed his wife Rabri Devi as CM during his arrest. "Former Bihar CM Lalu Prasad Yadav made his wife Rabri Devi the CM of the state when he was arrested. More recently, Hemant Soren in Jharkhand also resigned. Calling cabinet meetings in the jail or review meetings with officials in his cell does not seem practical," said Sharma.

Sharma further indicated that if AAP persisted in retaining Kejriwal as CM, it could lead to a deadlock, potentially prompting the Centre to impose President's rule in Delhi.

What may happen next?

Despite AAP's unwavering stance on Kejriwal's continuation in office, internal sources say that potential successors, including Atishi and health minister Saurabh Bharadwaj. Atishi, known for her extensive portfolio and close ties to Kejriwal, alongside Bharadwaj, a prominent minister with significant responsibilities, emerged as likely contenders. Additionally, sources speculated about the surprise candidacy of Kejriwal's wife, Sunita, given her background as a revenue services officer and active involvement in party affairs.

However, finding a successor of comparable stature to Kejriwal, a national convener of the party and three-time Delhi CM, presents a formidable challenge for AAP.

Role of Delhi's Lieutenant Governor

Delhi's unique power structure, featuring an elected Chief Minister and a Lieutenant Governor appointed by the Centre, presents a complex scenario. Kejriwal's ability to continue as CM hinges on legal relief, failing which the Lieutenant Governor can seek Presidential intervention, potentially leading to the imposition of President's rule.

Recent cases demonstrate how denial of bail can compel resignation, highlighting the precarious position of arrested officials.

In light of these developments, the Lieutenant Governor could invoke 'failure of constitutional machinery' to justify President's rule, thereby bringing the national capital under direct Union government control until the end of the current Assembly's tenure in February 2025.

Ottawa, Mar 16: An Indian-origin couple and their teenage daughter were killed in a "suspicious" fire which tore through their home last week in Canada's Ontario province, police said on Friday.

A fire engulfed a home at the Big Sky Way and Van Kirk Drive area of Brampton on March 7, a press release by the Peel Police said.

After the blaze was put out, investigators located what was believed to be human remains within the gutted house, but the number of people killed couldn't be ascertained at the time.

The charred remains were on Friday identified as those of three family members: 51-year-old Rajiv Warikoo; his wife, 47-year-old Shilpa Kotha; and their 16-year-old daughter, Mahek Warikoo.

Police said that they resided at the address before the fire.

Peel police Constable Taryn Young on Friday said the fire had been deemed suspicious, the CTV news channel reported.

"At this time, we are investigating this with our homicide bureau, and we are deeming this as suspicious as the Ontario Fire Marshal has deemed that this fire was not accidental," the report quoted Young as saying.

"There's not much left to it," Young said when asked about the possible cause of the fire.

"Looking into something like that as a fire marshal, I'm sure it's very tough when there is not much left to look at. But we are exhausting all avenues," she said.

The deceased family's neighbour, Kenneth Yousaf, said that the family had lived on the street for about 15 years, and he never noticed any problems with them.

Yousaf said he was alerted to the fire last week by a family member, who heard a big "bang." "When we came out, the house was on fire. So sad. Within a few hours, everything was down to the ground," the report quoted Yousaf as saying.

In a press release, police said they are continuing to investigate the deaths of the three family members and urged anyone with information to come forward.

"The circumstances surrounding the house fire remains the focus of an active investigation, and anyone with information or video footage (dashcam or otherwise) is urged to contact Homicide detectives," police said.

Mangaluru, Mar 18: The rising temperature has become a growing concern for residents of coastal district of Dakshina Kannada, as the issue of drinking water shortage continues to worsen in several parts. 

Though the water supply of Mangaluru city has not been affected much, nearby urban local bodies, including Ullal, Kotekar, Bajpe and other parts on the outskirts of Mangaluru have been facing an acute shortage of drinking water.

Though the water level in the Thumbe vented dam across Nethravati River has started going down in the last few days, officials have ruled out possibility of rationing the water supply in the city.

According to officials, the water level at Thumbe dam of the Mangaluru City Corporation (MCC) stood at 5.8 m as against the maximum storage capacity of 6m height on March 16. The water level at the dam during the same period last year was 5.3 metres. The water level reduced from 5.9 m on March 15 to 5.8 m on March 16 due to the scorching heat, causing evaporation.

The MCC has been drawing 160 MLD of water from the Thumbe vented dam. According to officials, without inflow, the maximum water stored in the dam will be sufficient for only 50 days. Meanwhile, the MCC has already started pumping backwater from downstream of the Thumbe vented dam back to the dam using pumpsets. Water from Thumbe dam can be drawn only if it has more than 1.5m of water in it.

DC Mullai Muhilan MP said that the district administration is closely monitoring water levels in all the dams that supply water.

The AMR dam located upstream of Thumbe dam has 18 m of water from sea level. If the water level in the Thumbe vented dam recedes, then water from the AMR dam will be released into the Thumbe dam. There is water in a dam at Biliyoor, which is located upstream of the AMR dam, the DC said.

“Drawing water for irrigation purposes from Thumbe and AMR dams has been banned,” the deputy commissioner said, adding that an order in this regard has already been issued. Some of the pockets in rural areas too have started facing water crisis.

“We have made arrangements to supply water through tankers in Ullal, Kotekar and Bajpe areas. We will not introduce water supply rationing in MCC limits for the time being,” he said and appealed to citizens to use water judiciously.
