Mangalore, Dec 21: The fourth additional district and sessions court that held 'Cyanide' Mohan Kumar guilty in three murder cases, sentenced him to death on Saturday.
Noting that the case falls under the rarest of rare category, judge BK Naik observed that Mohan committed the act aware of the consequences.
The death sentence will be carried out after confirmation from the high court.
The court has held Mohan guilty of murdering Anitha, 22, of Barimaru in Bantwal taluk, Leela, 32, from Kodambettu in Belthangady taluk and Sunanda, 25, of Peruvaje in Bellare village of Sullia taluk by administering them with cyanide. He is accused of murdering 20 women this way.
The hearing started in the fast track court but later was transferred to the present court. The case was argued for the state by Cheyyabba Beary, a retired public prosecutor. Mohan is defending his own case.
In the 125-page-long order copy, the judge sentenced him to five-year rigorous imprisonment and imposed Rs 5,000 penalty under Section 366 of IPC (kidnap), eight-year RI and Rs 5,000 penalty under Section 376 of IPC (sexual assault), death penalty under Section 302 (murder), five year rigorous imprisonment (RI) and penalty of Rs 5,000 under Section 392 (robbery), 10-year RI and penalty of Rs 10,000 under Section 394 (causing hurt in committing robbery), sixmonth RI and penalty of Rs 1,000 under Section 328 (administering poison), one-year rigorous imprisonment under Section 465 (forgery), three-year RI and penalty of Rs 2,000 under Section 468 (forgery for purpose of cheating), three year RI under Section 473 (making or possessing counterfeit seal) and three-year RI and penalty of Rs 3,000 under Section 201 (destroying evidence). He has been imposed with same punishment in all the three cases.
Rejecting the plea of leniency sought by convict Mohan Kumar on the grounds of his family members being dependent on him, the judge said there is not even a single mitigating circumstance that will come to the aid of the accused and no leniency would given to him considering the brutality of the crime he has committed. He has killed three innocent, unmarried and young women which is beyond the imagination of the ordinary man. Such brutal killing pricks the conscience of the society, he stated.
Speaking to media persons Mr Cheyabba Beary expressed his happiness about the verdict. “I am happy with the court's verdict on Cyanide Mohan. It is a warning and awareness message to other wrong dowers in society. He desires capital punishment because he had committed brutal crime repeatedly,” he said.
Convict Mohan Kumar told reporters that he is planning to move the High Court questioning the judgment.
