Police to invoke gang-rape section in Deralakatte forced sex case

Mangalore, Jan 5: For the first time in Mangalore, a non-governmental women's organisation approached the court and decided to implead in a criminal case.

The applicants, Jagrathi Mahila Vedike, Mangalore appealed to the JMFC III court to treat the recent Deralakatte kidnap and forced sex case as a case of gang-rape by invoking Section 376 (d) of the Indian Penal Code and sought a directive to the police to conduct a proper investigation and treat the offence as a gang rape.

The representatives of the organisation said that the police had invoked Section 354 (outraging the modesty of a woman) instead of Section 376 (d) (gang-rape), and contended that weaker charges would allow the accused to get bail easily.

Responding to the contention, Mangalore city police commissioner R Hithendra said that he had directed the investigating officers to invoke the sections.
