Mabrook Shah Rukh: Authority revokes benami attachment order against King Khan

New Delhi, Jan 29: Actor Shah Rukh Khan has been absolved of the charge of being a beneficiary of a benami property in the scenic beach town of Alibaug in Maharashtra as an appellate Authority under the law has "revoked" the attachment order of the I-T Department, calling it baseless and coloured.

The Adjudicating Authority (AA) slammed the income tax department authority for issuing the order against Khan and a company-- in which he, his wife Gauri Khan and in-laws are shareholders-- in February last year, saying a "commerical transaction entered into course of business by an independent entity cannot be coloured as benami transaction because it had sourced the funds from loans."

A division bench of the AA comprising D Singhai (Chairperson) and Member (Law) Tushar V Shah exonerated Khan and said: "We have come to the conclusion that the named properties, ie, agriculture land at village Thal, Taluka Alibaug bearing survey nos 188/A, 188/1B, 188/2, 188/3, 188/4, 187/1 and structure thereon are not a benami property and hence the attachment made thereof by the investigating officer is revoked hereby."

The tax department had attached the farm house and plot, built on an agricultural land, in Alibaug, worth about Rs 15 crore, and had called the company-Ms Deja Vu Farms Pvt Ltd- a benamidar (in whose name benami property is standing) and the 53-year-old actor a beneficiary (who pays money consideration) of a benami deal booked under the Prohibition of Benami Property Transaction Act.

The 1988 enacted law was implemented by the Modi government from November, 2016 with a strong impetus, saying it was aimed to crack down against black money and stash holders.

The AA bench, in the order accessed by PTI, also rapped the probe officer of the I-T Department in Mumbai for seemingly relying on "some press report/online articles" that Khan acquired the property for his benefit, which it said was "incorrect and impermissible in law."

"There is no basis to conclude that the property acquired by Deja Vu Farms Pvt Ltd is held for immediate or future benefit, direct or indirect of Shah Rukh Khan," the January, 23 issued order said.

The Authority rejected the I-T Department's allegation that the entire transaction of purchasing the land parcels in Alibaug and construction of a luxury farm house on it was done on the "desire and instruction"of Khan and from "unsecured loans" of about Rs 14.67 crore provided by him to the firm.

The I-T had also charged that as Khan was "not an agriculturist, he sought to purchase the land by forming Ms Deja Vu Farms Pvt Ltd, a front entity and giving it colour of company engaged in agriculture."

The department had also said in its order that a person Moreshwar Rajaram Ajgaonkar was a "front" of Khan as the the actor used the former's credentials of being an agriculturist to purchase the land by making a representation under the said category before the Additional Collector of Raigad, the district under which Alibaug falls.

It had also charged that the company was incorporated "on the instructions" of Khan as he was interested in purchasing a property in Alibaug for construction of a farm house.

The taxman had said in its complaint that the objective of the firm (Deja Vu) was stated to undertake agricultural activity on the land and the Raigad district state government gave permission to purchase the land with a "condition" that it will be put to use within 3 years for the purposes of farming.

The AA also found as "justified" the contention of Khan and his company that a private firm can borrow funds even from its shareholders and that there has been no concealment of the loan given by the actor which has been "disclosed" by the former in its annual returns for the last several years.

The Authority said that it was "beyond doubt" that the Alibaug property was acquired and held by the company in its own right and independent of any other person.

"There is nothing to raise the inference or presumption in law that the property owned by a company can be said to be held for the benefit of its shareholder," the Authority ruled, absolving Khan of the criminal charges under the stringent law.

As per the anti-benami law, once proven, a benamidar (in whose name benami property is standing) and beneficiary (who pay money consideration) are prosecutable and may face rigorous imprisonment up to 7 years besides being liable to pay fine up to 25 per cent of fair market value of benami property.

Bengaluru, Apr 29: HD Revanna, the father of Karnataka MP Prajwal Revanna, has accused rivals of creating a conspiracy out of "old videos", a comment that is likely to raise a bigger row over his son's alleged link to the obscene videos.

A woman yesterday filed a police case against Prajwal Revanna and his father over alleged sexual assault. Prajwal Revanna, the Janata Dal (Secular) MP and grandson of former Prime Minister HD Deve Gowda, has denied the latest allegations and also filed a police complaint over circulation of obscene videos, which he said were morphed.

Prajwal Revanna left for Germany on Saturday morning after voting in the Lok Sabha elections a day earlier.

"I know what kind of conspiracy is going on. I am not someone who'll get scared and run away. They have released something that was 4-5 years old. Expelling him from the party is left to the party high command," HD Revanna said.

When it was pointed out that an FIR has been registered against him too, he said, "There is politics, I don't want to comment. They (Congress) are in government and they will do whatever they want."

"All these things are not just today, the Deve Gowda family in the last 40 years (has been targeted by) Congress. CoD (now CID), Lokayukta probe, we have been facing for the last 40 years... I don't want to react to anything...let them take action in accordance with law," he said, adding that he hasn't spoken to Deve Gowda on the issue.

"Since the special investigation team is looking into the case, I will not react any further," HD Revanna said.

Yesterday, a first information report was filed against the father-son duo on charges of sexual harassment, intimidation and outraging the dignity of a woman.

The survivor alleged both sexually assaulted her, and when Revanna's wife was not home, he touched her inappropriately and used to sexually assault her. The complainant alleged Prajwal Revanna also misbehaved with her daughter over a video call. "My daughter blocked his number after repeated calls," the complainant said.

The latest FIR comes when Prajwal Revanna is already in the middle of a controversy after some objectionable videos went viral on social media allegedly involving him.

Prajwal Revanna is seeking a fresh term in the Lok Sabha from as a National Democratic Alliance (NDA) candidate from Hassan.

Guwahati: Union Home Minister Amit Shah on Tuesday condemned the alleged sexual abuse of women involving Lok Sabha MP Prajwal Revanna, asserting that the BJP will not tolerate any insult to women.

Revanna (33) is the BJP-JD(S) alliance candidate for Hassan Lok Sabha constituency, which went to polls on April 26.

Earlier in the day, the JD(S) suspended Revanna from the party with immediate effect.

“The issue regarding Revanna that has been reported in the media is very hurtful and cannot be tolerated in any way,” Shah told a press conference here.

“The BJP’s stand is very clear; we will not tolerate any insult to ‘matri aur nari shakti’ (women empowerment),” he asserted.

Some explicit video clips allegedly involving Prajwal Revanna, the grandson of former prime minister H D Deve Gowda, were circulated in Hassan over the last few days.

The home minister said Congress has been alleging that an NDA partner’s candidate is involved in the incident, “but I just want to ask a small question - whose government is there in that state (Karnataka)?”

“The Congress is in power in Karnataka, and this matter must have come to their attention. Why has it not taken any action on it so far? We cannot take any action as law and order is a state issue,” Shah said.

Hubballi, Apr 23: Karnataka Chief Minister Siddaramaiah on Tuesday spoke to father of slain student Neha Hiremath over phone and said "sorry" over his daughter's killing, and assured that "we will be on your side".

The Chief Minister also informed Niranjan Hiremath, who is also a Congress councillor of Hubballi-Dharwad Municipal Corporation, about the government's decision to hand over the murder case to the Criminal Investigation Department (CID) and setting up a special court to fast-track trial.

"Niranjan... very sorry. We will be on your side," Siddaramaiah told Hiremath over the phone call during state's Law and Parliamentary Affairs Minister H K Patil's visit to Hiremath's house here.

In the conversation on Patil's phone with speakers on, Siddaramaiah can be heard informing Hiremath about the CID probe and setting up a special court.

"It is a serious offence... setting up a special court will ensure punishment for the accused person."

Hiremath thanked Siddaramaiah on behalf of his family well-wishers and the community for handing over the case to CID and setting up a special court "...ensure there is an order at the earliest and provide us justice," he said, as he also thanked Patil, Home Minister G Parameshwara, local Congress MLA Prasad Abbayya and others for their support.

Replying to this, Siddaramaiah said, "We will ensure it, at the earliest."

In a shocking incident, Neha Hiremath (23), was stabbed to death on the campus of BVB College last Thursday. The accused Fayaz Khondunaik, who fled from the scene, was arrested by the police subsequently.

Neha was a first year Master of Computer Application (MCA) student and Fayaz was earlier her classmate.

Siddaramaih on Monday had announced his government has decided to hand over the investigation into the incident to the Crime Investigation Department, and to set up a special court for speedy disposal of the case.

The case of brutal murder, which sparked widespread outrage, has snowballed into a political slugfest between ruling Congress and opposition BJP.

While the ruling party has tried to project it as an incident with personal angle, the saffron party has called it a "love jihad" case and has said it's a testimony of deterioration of law and order in the state.

Earlier, Siddarmaiah's statement that the murder was due to "personal reasons" and Home Minister G Parameshwara's comments that the duo was in love, has elicited sharp reactions from Hiremath and family members and opposition parties.
