Gujarat Assembly passes controversial Anti-Terror Bill

Gandhinagar, Mar 31: Gujarat Assembly today passed by a majority vote the controversial Control of Terrorism and Organised Crime (GCTOC) Bill which allows police to intercept and record telephonic conversations and submit them in court as evidence.

The Bill, which was earlier returned by the President thrice to the state government for reconsideration, was passed by a majority vote amid stiff resistance from Opposition Congress, which walked out of the House over its controversial provisions.

The state government re-introduced the Gujarat Control of Organised Crime (GUJCOC) Bill in the Assembly after renaming it. The bill, however, has retained the controversial provisions.

The contentious provisions of the bill include admissibility of evidence collected through telephonic interception and confession made before police officer as evidence in court.

The GUJCOC Bill, which was on the lines of the stringent Maharashtra Control of Organised Crime Act (MCOCA), was rejected in 2004 and 2008 by then President AJP Abdul Kalam and Pratibha Patil respectively.

After its passage for the third time in the State Assembly without any changes, the Bill is still pending for clearance from the President.

The Bill was today again introduced in the House by Minister of State for Home Rajnikant Patel, after which a long debate took place on it, in which Opposition Congress demanded removal of controversial sections like telephonic interceptions, confessions made before some police officer as evidence and time limit of 180 days for filing of chargesheet.

At the end of the discussion, Congress leader Shankarsinh Vaghela and Shaktisinh Gohil insisted that the controversial provisions should be dropped as per the suggestions of past Presidents when they rejected the Bill.

However, Patel said that the provisions of this Bill are in favour of the nation, the people of this country and it allows us to take action against traitors and refused to drop those sections.

Subsequently, Congress walked out of the House.

Later, the Bill was passed by majority vote in the State Assembly.

Section 14 of the Bill says, "Notwithstanding anything contained in the code or in any other law which is in force, the evidence collected through the interception of wire, electronic or oral communication under the provisions of any other law shall be admissible as evidence against the accused in the court during the trial of the case."

According to Section 16 of the Bill, accused's statement before a police officer, not below the rank of Superintendent of police, will be treated as an evidence.

While, Section 20 (2) (b) says stipulated time to complete probe and file the chargesheet can be exceeded to 180 days (six months) from the current stipulated time of 90 days.

Another controversial provision under the bill is section 20 (4), which reads "no accused person in this act shall be released on bail or on his own bond unless the public prosecutor has been given an opportunity to oppose the application, the special court is satisfied that there are reasonable grounds for believing that accused is not guilty of such offence and that he is not likely to commit any offence while on bail."

The cases under the act can be tried only in a special courts set up for this purpose.

Congress leader Shaktisinh Gohil objected to the provisions of the Bill and said that some of them are even unconstitutional.

He told the House that the provision of confession before a police officer is contradictory with Indian Evidence Act as according to Section 164 of CrPC and Indian Evidence Act, a statement before the magistrate can only be considered as an evidence.

On the provision of not releasing an accused on bail, Gohil said the provision is unconstitutional which deprives the right of an accused to get released on bail on his own bond.

However, the government justified the provisions in the Bill by saying that existing legal frame work like the penal and procedural laws and adjudicatory system have been found to be rather inadequate to curb or control the menace of organised crime.

"It is therefore considered necessary to enact a special law with stringent and deterrent provisions," the state government said in the objectives of the Bill.

About the provision of telephonic interceptions, the 'Statement of Objects and Reasons' in the Bill states that this is necessary in these times where organised criminal syndicates make extensive use of wire and oral communication.

It says that the interception of such communication to obtain evidence is inevitable and an indispensable aid for the law enforcement.

Former President APJ Abdul Kalam had in 2004 raised objections over section-14 (telephonic interception as evidence) and returned the bill to the government led by the then chief minister Narendra Modi, asking it to remove the clause.

Later in 2008, the Bill was passed after deleting the clause related to interception of communication, as per the suggestion of Kalam.

However, then President Pratibha Patil rejected it and suggested some more amendments. One of them was to eliminate the provision which allows admissibility of confession made before a police officer in the court as evidence.

However, ignoring the suggestion, the state government had once again passed the bill in 2009 for the third time and sent it for President's approval.

The old Bill is still pending with the President.

But, the ruling BJP hopes that as the NDA government is in power on at the Centre, the new bill is sure to pass the test there.

Bengaluru: The Congress and BJP will lock horns on the electoral battleground again, in less than a year, in Karnataka as the stage is set for voting in the first phase in 14 Lok Sabha seats on Friday.

It's going to be a straight fight between the ruling Congress and the BJP-JD(S) combine unlike the Assembly elections in May last year which witnessed a triangular contest among the three parties.

The state has a total of 28 Lok Sabha constituencies. The second phase of polling in the remaining 14 seats is on May seven.

A total of 247 candidates -- 226 men and 21 women -- are in the fray for the first phase in most of the southern and coastal districts.

More than 2.88 crore voters are eligible to exercise their franchise in 30,602 polling stations where polling will take place between 7 am to 6 pm.

While the Congress is contesting in all 14 seats, BJP has fielded nominees in 11 and its alliance partner JD(S), which joined the National Democratic Alliance (NDA) in three -- Hassan, Mandya and Kolar.

Besides the three, the segments where elections will be held on Friday are: Udupi-Chikmagalur, Dakshina Kannada, Chitradurga, Tumkur, Mysore, Chamarajanagar, Bangalore Rural, Bangalore North, Bangalore Central, Bangalore South and Chikkballapur.

In the 2019 Lok Sabha polls, Congress and JD(S), which were in alliance and ruling the state then, had secured just one seat each in these 14 segments. The BJP had won in 11 and ensured the victory of a party supported independent candidate in Mandya.

Having scored a thumping victory in the Assembly elections, the Congress now appears determined to put up a strong show.

Karnataka is the most important state for the BJP in south India as it's only here that it had held power in the past. 'Its alliance partner JD(S) is fighting to remain politically relevant, after the Assembly poll drubbing,' a political analyst said.

The Old Mysore region is the Vokkaliga heartland and parts of it have been the traditional bastion of the JDS.  However, the current elections are a battle for survival for JDS.

According to Karnataka Chief Electoral Officer Manoj Kumar Meena, 1.4 lakh polling officials will be on duty for the first phase.

Besides them, 5,000 micro-observers, 50,000 civil police personnel, 65 companies of Central Parliamentary Force and State Armed Police force of other States will also be deployed for security.

All the 2,829 polling stations of Bangalore Rural parliamentary constituency will be webcast, Meena said.

'This is as per the request of our returning officers and observers; so we have given more than double the Central parliamentary force for Bangalore Rural constituency. Seven companies of Central paramilitary forces have been inducted at the constituency since April 22,' he told reporters on Wednesday.

In fact, out of the total 30,602 polling stations in the first phase, 19,701 will be webcast, and 1,370 covered via CCTVs, he said.

Chikkaballapur has a maximum number of 29 candidates, followed by 24 in Bangalore Central, and Dakshina Kannada has the least number - nine.

JD(S) leader H D Kumaraswamy from Mandya, his brother-in-law and noted cardiologist C N Manjunath from Bangalore Rural on a BJP ticket, erstwhile Mysuru royal family scion Yaduveer Krishnadatta Chamaraja Wadiyar from Mysore, also from the BJP, and Deputy Chief Minister D K Shivakumar's brother and MP D K Suresh of Congress from Bangalore Rural, are among the prominent candidates in the fray in the first phase.

Also in the fray are BJP MP Tejasvi Surya from Bangalore South against Minister Ramalinga Reddy's daughter Sowmya Reddy of Congress, Union Minister Shobha Karandlaje on BJP ticket from Bangalore North against former IIM Bangalore professor M V Rajeev Gowda of Congress.

The Congress' performance in the elections, especially in the first phase which covers almost all Vokkaliga-dominated districts, is being seen as a big test of sorts for its state unit chief Shivakumar, who has made no secret of his ambition to become chief minister, amid speculations of change in guard mid-way of the Assembly term.

Stakes are also high for Chief Minister Siddaramaiah, as victory in particular in his home turf—Mysore and Chamarajanagar—is seen as key for strengthening hands, analysts say.

For the JD(S) and its state chief Kumaraswamy, the task is cut out -- to prove that the regional party is still a force to reckon with, particularly in the Vokkaliga dominated Old Mysuru or South Karnataka region.

Both Shivakumar and Kumaraswamy are Vokkaligas, and are engaged in a fierce turf war to consolidate their clout over the dominant community.

It is also seen as a kind of a 'litmus test' for state BJP president B Y Vijayendra, who has the onerous task of helping the party retain its supremacy in the Lok Sabha elections.

Ensuring a BJP sweep is paramount for the son of veteran leader B S Yediyurappa, to consolidate his position and silence critics who have questioned his selection for the post, overlooking seniors and seasoned hands.

The ruling Congress is mostly banking on the implementation of its populist five guarantee schemes. The BJP and JD(S) seem to be leveraging the 'Modi factor' to the hilt.

Mangaluru: This year too, the Mangaluru International Airport has missed being designated as an embarkation point for the annual hajj pilgrimage. 

According to the Haj Committee of India, not many are choosing Mangaluru as an embarkation point. Last year, although Mangaluru was notified as one of the embarkation points, the Union government removed it from the list at the last minute.

Several associations and organisations submitted memorandums to the Haj Committee of India, requesting the reinstatement of Mangaluru as one of the embarkation points, but their efforts have not materialised this year either.

The use of Mangaluru Airport as an embarkation point for the haj began in 2010. In 2019, 1,400 haj pilgrims flew from MIA to Saudi Arabia.

“When the number is less, it is difficult to consider it. It was the same issue as last year,” reacted AP Abdullakutty, chairman of the Haj Committee of India.
Mangaluru as an embarkation point served people from undivided Dakshina Kannada, Kodagu, Shivamogga, Uttara Kannada, and Chikkamagaluru districts.
Last year, the Muslim Central Committee of Dakshina Kannada and Udupi districts submitted a memorandum to Abdullakutty. They expressed their disappointment with Abdullakutty and stated that Mangaluru had a good number of applicants ever since it was identified as an embarkation point. 
Now, they have to travel to Bengaluru. 

UT Khader, speaker of the Karnataka legislative assembly, pointed out that several Union ministries are involved in the process of designating embarkation points for the haj.

“We are not sure why MIA as an embarkation point was removed. Is it because of fewer applications, or are airlines not willing to bid for MIA as an embarkation point? Is it only an issue with MIA as an embarkation point, or are there other airports in the country facing similar issues? We will try to find out and seek answers. Meanwhile, we will also start working at the earliest so that MIA is considered as an embarkation point for hajj next year,” said Khader.

Karwar, May 5: What commenced as a mere exchange of words between spouses swiftly transmuted into a calamitous ordeal, resulting in the heartbreaking loss of their innocent offspring. The heart-wrenching incident unfolded in the serene confines of Halamaddy village in the picturesque expanse of Dandeli, nestled within the idyllic expanse of Uttara Kannada district.

In the throes of a fervent dispute with her spouse, the aggrieved wife, succumbing to an overwhelming surge of emotions, callously propelled their tender six-year-old progeny into the somber depths of a nearby canal, thereafter alerting the local populace to her grievous act.

Promptly apprised of the distressing occurrence by concerned bystanders, the authorities were swiftly summoned to the scene to confront the harrowing aftermath.

Responding to the distress call, the diligent officers of Dandeli rural police swiftly converged upon the site where the innocent child had been cast into the unforgiving waters of the canal, subsequently effecting the retrieval of the child's lifeless form. 

Regrettably, it was discerned that a portion of the child's remains had been tragically claimed by the lurking jaws of a predatory crocodile.
