Mangaluru, May 22: A youth was sentenced to one year imprisonment and a fine of Rs. 1.5 lakh for uploading the morphed nude pictures of an air hostess on social media.
He was arrested after an Air India air-hostess lodged a complaint with Kavoor police station in Mangaluru five years ago against ‘unknown miscreants’ who had created Facebook profile using her name and morphed pictures.
The 3rd Judicial Magistrate, First Class, Mangaluru, Undi Manjula Shivappa, while sentencing the youth called his behaviour "vile and disgusting".
The air hostess, who was residing in a flat in Konchady locality in city, had approached police after she started receiving calls on her mobile seeking sexual favours.
In her complaint, on February 21, 2010, she had stated that someone had morphed her pictures on some nude photos and posted it on Facebook by giving her mobile number
The probe was led by then police inspector Valentine D’Souza. The investigators communicated with the headquarters of the social networking site and collected IP address of the computer that was used to create the profile.
The IP address was traced to complainant's childhood friend in West Bengal. After his arrest, he had admitted to morphing the image of his friend as he was not happy with her moving with her boyfriend.
The police also sent the computer used by Gupta to Central Forensic Science Laboratory, Hyderabad, which confirmed morphing of girl’s photographs.
Prosecutor Mohan Kumar said CFSL’s Assistant Examiner Krishna Sastry Pendyala and nine others, including the complainant and her boyfriend, were examined during the trial. Her boyfriend turned hostile during his examination.
Based on the documentary and expert evidence, the magistrate convicted Gupta under Sections 66 and 67 of the Information Technology Act. Of the Rs. 1.5 lakh fine amount, the magistrate has directed the convict to pay Rs. 1 lakh towards mental agony suffered by the girl.
