Govt asks Law Commission to examine uniform civil code issue

New Delhi, Jul 1: Government has asked the Law Commission to examine the issue of implementation of a Uniform Civil Code, a move welcomed by the BJP and opposed by the Muslim Majlis and some activists.

The Department of Legal Affairs has asked the Commission, a recommendatory body, to submit a report on the issue that has always been dear to BJP and the sangh parivar.

The move assumes significance as the Supreme Court had recently said it would prefer a wider public debate before taking a decision on the constitutional validity of 'triple talaq', which many complain is abused by Muslim men to arbitrarily divorce their wives.

The government is likely to inform the Supreme Court of its decision to refer the matter of the common code to the Law Commission when the matter comes up in September.

Reacting to the government decision, the BJP favoured a uniform civil code saying that it has been opposed due to vote bank politics despite finding a mention in the Constitution.

"There should be an open debate over it. The Constitution calls for it and those who oppose it only shows their intolerance to the Constitution. We have always advocated it. There should be uniform civil code. It has been opposed due to vote bank politics," party's National Secretary Shrikant Sharma said.

Implementation of a uniform civil code is one of the core issues of BJP and the sangh parivar but the NDA governments in 19989 and 1999 and the current dispensation headed by Narendra Modi have put the contentious issues like scrapping of Article 370 and construction of Ram temple on the back burner.

All India Majlis-e-Ittehadul Muslimeen's Asaduddin Owaisi dubbed the decision of the government as a move to turn the nation into a "Hindu Rashtra".

"I challenge the government to impose total prohibition. If the government is serious about the civil code, it should withdraw the tax rebate extended to Hindu Undivided Families in the next session of Parliament," he said.

He claimed that the government is diverting the attention of the people as it has failed to provide employment and fuel the growth of the economy.

Shaista Amber, who had been fighting for the cause of Muslim women, said the Commission should hold wider consultations before reaching at a conclusion.

But senior advocate K T S Tulsi said the issue of a common civil code is related to equal rights for both men and women as enshrined in the Constitution.

He wondered why only men have thew right to give a triple talaq. "That right should be with Muslim women also," he said.

Law Minister D V Sadananda Gowda had earlier said that the issue could be referred to the Law Commission for examination.

Gowda had said "wider consultations" will be held with various personal law boards and other stakeholders to evolve a consensus and the process may take some time.

"...Even the Preamble of our Constitution and Article 44 of the Constitution do say that there should be a Uniform Civil Code...it needs to have a wider consultation," he had said.

A decision "cannot be done in a day or two. It will take its own time", Gowda had said.

Implementation of a common civil code is part of the BJP's election manifesto. But the NDA, when it came to power in 1998 and 1999 and now under Narendra Modi, had kept contentious issues, including the UCC, on the back burner.

Madikeri, May 11: Kodagu police have apprehended the man allegedly responsible for the brutal murder of a minor girl within the confines of Kumbaragadige village in Karnataka's Somwarpet taluk. 

Kodagu Superintendent of Police, K Ramarajan, disclosed that the arrested individual is Prakash (32) from Hammiyala village in Somwarpet taluk. However, authorities are still in the process of recovering the severed head of the victim. The perpetrator had absconded with the victim's severed head after committing the crime. 

Search operations for the suspect commenced late on Thursday night (May 9), with officials diligently pursuing leads. Acting on information suggesting the suspect's presence in a forested area near the village, the police swiftly moved in and apprehended him.

The victim US Meena, 15, a student of Surlabbi High School, had passed the SSLC examinations, the results of which were announced on May. One same day, she was murdered. 

Reportedly, the engagement of the minor girl with the suspect was thwarted by officials from the Women and Child Development department. Subsequently, officials persuaded the girl's parents against proceeding with the marriage. 

However, despite these interventions, the suspect forcibly entered her residence during the night, purportedly abducted her, and later perpetrated the heinous crime in a wooded area on the outskirts of the forest, before absconding with her severed head.

Hassan MP and Lok Sabha election candidate of the BJP-JD(S) alliance Prajwal Revanna, who is facing an inquiry over the alleged sexual abuse of several women, said the truth will prevail.

The MP, who left the country as soon as the election to his constituency ended, has also sought seven days' time to appear before the Special Investigation Team (SIT) formed by the Karnataka government to inquire into the huge cache of about 3,000 explicit videos and photos allegedly pertaining to him, which have gone viral on social media.

“As I am not in Bangalore to attend the enquiry, I have communicated to CID Bangalore through my advocate. Truth will prevail soon,” Prajwal, grandson of former prime minister and JD(S) patriarch H D Deve Gowda, said in a post on X.

A case has been registered against MLA and former minister H D Revanna and his son Prajwal at Holenarasipura on a complaint lodged by their former cook and relative for allegedly sexually harassing her.

She also alleged that Prajwal made video calls to her daughter and spoke in an objectionable manner, which forced her to block him.

The MP who is seeking re-election from Hassan on a JD(S) ticket, shared a letter by his lawyer Arun G to the Deputy Superintendent of Police of the SIT, in which he has sought seven days' time to appear before the official because he is abroad.

Mangaluru, June 10: The National Investigation Agency (NIA) has arrested another prime accused in 2022 BJP Yuva Morcha worker Praveen Nettaru murder case. 

32-year-old Jilla BJP Yuva Morcha committee member Nettaru was hacked to death in front of his broiler shop in Bellare of Dakshina Kannada by bike-borne miscreants in July 2022. The case is being investigated by the NIA and several arrests have been made so far.

Mustafa Paichar, accused number four in the case, was absconding after the murder and the NIA had declared a Rs 5 lakh reward to catch him. 

He was arrested at Sakleshpur in Hassan district by the NIA team led by Inspector Shanmugam. 

According to officials Mustafa was reportedly a member of now banned Popular Front of India and a resident of Shantinagar in Sullia in Dakshina Kannada.
