PhD scholar Gulzar Ahmed lost 16 yrs in jail; UP govt should compensate: Court

May 23, 2017

New Delhi, May 23: The Uttar Pradesh government has been directed by a Barabanki court to compensate former AMU scholar Gulzar Ahmed Wani, who was acquitted of terror charges after 16 years of incarceration in the 2000 Sabarmati Express blast case.

The court directed the Yogi Adityanath-led government to pay compensation to Wani in terms of the average income in accordance with his educational qualification for the time he spent in jail, saying he was a victim of "negligence" of officials in probing the case.

Wani was pursuing PhD in Arabic from Aligarh Muslim University when he was arrested from Delhi on July 30, 2001.

The court held the UP government responsible for the damage caused by its officials to the state exchequer for their negligence in probing the case leading to financial loss.

It said the officials had not obtained sanction to prosecute the accused and a charge sheet was filed in dereliction of their duty, violating Wani's physical independence and also harming him physically and mentally.

The court's findings came as it acquitted Wani and Mohd Abdul Mobeen of the charge of having allegedly orchestrated the Sabarmati Express blast in 2000 that had claimed nine lives and left several others injured.
It said the police had not produced any evidence to prove that the two had conspired with others to cause a bomb blast in the train and wage a war against the country.

Additional Sessions Judge M A Khan, in his judgement written in Hindi, said if the government feels, it can recover the compensation amount from the concerned police officials.

It said if the government failed to pay the compensation, Wani would be at liberty to approach the Allahabad High Court.

A total of 11 cases were lodged against Wani, of which he has been exonerated in 10 -- either acquitted or discharged.

The Supreme Court had granted bail to Wani in April this year, observing that he has suffered incarceration for over 16 years and has been acquitted in nine out of 11 cases.

The apex court had said that Wani should be released on bail from November one on set terms and conditions of the trial court, irrespective of the completion of the trial.

In one case, Wani was convicted and sentenced to 10 years in jail for carrying explosives to trigger a blast in Delhi. However, the Delhi High Court had suspended this sentence.

His counsel M S Khan said "an intellectual person's life has been spoilt. There is an irreparable damage to his career. He was such an educated person and would have excelled in his life. The erring police officials should be punished and they must be taught a tough a lesson."

While reprimanding the police officials for their lapses in investigation, the court said neither did they try, nor did they gather any evidence in support of the charge of criminal conspiracy against the accused.

The judge said it was the duty of senior police officers to check the charge sheet, remove the defects and file it in the court, but they showed negligence in their duty which also harmed the government.

The court directed the government to take appropriate action against the erring police officials and said that a copy of the judgement be sent to the district magistrate, Barabanki, and the Home Secretary of the state government.

Wani, who was arrested by Delhi Police in 2001 allegedly with explosives and incriminating materials, is a resident of Peeparkari area of Srinagar in Jammu and Kashmir and is lodged in a jail in Lucknow.

The blast was carried out on the eve of Independence Day near Kanpur when the train was on its way from Muzaffarpur to Ahmedabad, claiming nine lives and several others injured.

The prosecution had alleged that the accused had hatched a conspiracy in May 2000 at the Habib Hall of the Aligarh Muslim University to carry out a blast in the Sabarmati Express on August 14, 2000. Charges were framed against him in July 2001.

Bengaluru: All India Mahila Congress President Alka Lamba on Monday accused the BJP and JD(S) of being silent over the alleged sex scandal involving Hassan MP Prajwal Revanna and said the horrifying case of violence against women has shocked the nation.

"More than 3000 videos with hundreds of women being sexually harassed, violated and even brutalised by MP Prajwal Revanna over the past few years have shaken the conscience of Kannadigas and Indians alike," she told at a press conference here.

Prajwal (33) is grandson of JD(S) supremo and former Prime Minister H D Deve Gowda. JD(S) joined the NDA in September last year. He was the NDA candidate in Hassan Lok Sabha constituency, which went for polls on April 26.

According to police sources, he left the country after voting was over.

The Congress government in Karnataka on Sunday constituted a Special Investigation Team to probe the alleged sex scandal.

Some explicit video clips allegedly involving Prajwal had started making the rounds in Hassan in recent days.

Lamba said the horrifying case of sexual violence against hundreds of women has shocked the nation.

"These acts of sexual brutality against hapless women has revealed the depravity of MP Prajwal Revanna, but the silence and sheer apathy of the BJP and JDS in this horrendous case is absolutely shameful," she said.

She alleged that in these videos, some recorded against the consent of the victim, women are seen pleading to be spared but the MP continues to brutalise and sexually violate them. Party 'karyakartas', panchayat members, elderly women, women who came asking for help to him and even maids have not been spared.

"The horrible fact is, that the acts of this sexual predator MP Prajwal Revanna was endorsed by Prime Minister Narendra Modi as he campaigned in Old Mysuru Region on April 14th, 2024," she alleged.

"....the BJP JDS are still silent which shows you their true Anti Woman DNA!! Will the BJP or JDS answer?".

Hassan MP and Lok Sabha election candidate of the BJP-JD(S) alliance Prajwal Revanna, who is facing an inquiry over the alleged sexual abuse of several women, said the truth will prevail.

The MP, who left the country as soon as the election to his constituency ended, has also sought seven days' time to appear before the Special Investigation Team (SIT) formed by the Karnataka government to inquire into the huge cache of about 3,000 explicit videos and photos allegedly pertaining to him, which have gone viral on social media.

“As I am not in Bangalore to attend the enquiry, I have communicated to CID Bangalore through my advocate. Truth will prevail soon,” Prajwal, grandson of former prime minister and JD(S) patriarch H D Deve Gowda, said in a post on X.

A case has been registered against MLA and former minister H D Revanna and his son Prajwal at Holenarasipura on a complaint lodged by their former cook and relative for allegedly sexually harassing her.

She also alleged that Prajwal made video calls to her daughter and spoke in an objectionable manner, which forced her to block him.

The MP who is seeking re-election from Hassan on a JD(S) ticket, shared a letter by his lawyer Arun G to the Deputy Superintendent of Police of the SIT, in which he has sought seven days' time to appear before the official because he is abroad.

Bengaluru: In a shocking revelation, a former member of Hassan Zilla Panchayat (ZP) has accused incumbent JD(S) MP Prajwal Revanna of raping her multiple times over three years and videographing the alleged crime.

A case was registered by the Criminal Investigation Department (CID) based on the statement by the 44-year-old survivor on Wednesday, May 1.

According to the First Information Report (FIR), the woman claimed that when she was a ZP member she used to visit the MLAs and MPs for various development works.

In one such instance in 2021, she met Prajwal seeking his help to get hostel seats for some female students at a local college. The woman, in her statement, said that since the MP was busy, she was asked to meet him the next day.

“The following day I visited the MP at his office and the MP's quarters in Hassan. The staff present there told me to wait on the first floor as there were many others in the hall. Prajwal spoke to some of the women waiting there, spoke with them and sent them off until I was the only one left,” the woman alleged.

As per the survivor, the MP then called her inside a room and she obliged.

“He held my hand, pulled me inside and locked the door. When I asked him why was he closing the door, he told me nothing would happen and made me sit on the bed. He said my husband should talk less and warned me of the consequences. He also said that because of my husband, his mother, Bhavani Revanna, missed the MLA ticket. He told me that if my husband wants to grow politically, I should listen to him [Prajwal],” the woman alleged.

Next, Prajwal allegedly told the woman to lie down on the bed and undress. When the woman refused and said that she would shout, Prajwal allegedly threatened her that he had a gun and warned of dire consequences for her and her husband.

The woman alleged that Prajwal took out his mobile phone and then raped her.

“He raped me and sexually assaulted me and recorded the act on his mobile phone,” the woman alleged. “He threatened to leak the video if I ever spoke about it and told me to be there whenever he wanted. After that, he used to video call me frequently, ask me to be naked during the call and raped me in multiple instances.”

The woman claimed that she was scared and did not make the incident public and chose to come forward after she learnt of the Special Investigation Team (SIT) set up by the Karnataka government to probe the alleged Hassan sex scandal.

A case was registered under Sections 376(2)(n) (commits rape repeatedly on the same woman), 506 (criminal intimidation), 354A(1)(physical contact and advances involving unwelcome and explicit sexual overtures), 354B (assault or use of criminal force to woman with intent to disrobe) and 354C (voyeurism) of the Indian Penal Code (IPC) and 66E (violation of privacy) of the Information Technology (IT) Act.

Prajwal is also accused in a sexual harassment case along with his father, Holenarasipur MLA HD Revanna, registered at the Holenarasipur police station in Hassan on April 28.
