
Mangalore, Jan 14: In one of its kind, a citizen has urged the Apex Court to intervene and see to it that the lower court takes his case up for hearing, before his death!
Well, the person concerned is none other than social activist, PUCL national Vice-President P B D'Sa, who in an open letter to the Chief Justice of Supreme Court of India said that in the course of his work, which is done gratis, without expecting any returns or rewards he had an opportunity to file an F.I.R in the Police Station in Mangalore under section 153A & B and section 295 A on 28-12-2008. However, the politically motivated Police filed a 'B' report against the F.I.R.
“With this I was compelled to seek Justice before the Judiciary. Though 4 long years have elapsed and I have presented myself before the Court continuously on every date, even verification statement has not been completed by the Court. Judiciary seems to be punishing a law abiding citizen who is sufficiently motivated, in spite of old age and illnesses. Possibly the accused as well as the complainant may die a natural death without Justice being done in this case. Even the witnesses may not live till the case is taken up,” he said in his letter requesting the Apex Court to intervene and try to solve the hitches and problems faced by the lower Court.
He further said that while State cases are taken up expeditiously it is not understood why a citizen's complainant is treated with scant respect.
