Supreme Court turns down govt plea to re-open NRC process in Assam

New Delhi, Aug 13: The Supreme Court of India today declined the plea of Prime Minister Narendra Modi-led union government and Assam state government to re-open the National Register of Citizens (NRC) process in Assam and conduct a sample re-verification of data collected, especially in the border districts of the State where Muslims are in majority.

A Bench of Chief Justice Ranjan Gogoi and Justice Rohinton Nariman said the security regime for the NRC data should be on the same lines as that of Aadhaar information.

Only hard copies of lists of inclusions and exclusions should be provided at the district offices and the list of exclusions should be published only once.

Orders under Illegal Migrants (Determination by Tribunal) Act should be challenged in the Guwahati High Court. The NRC data should only be published online on August 31.

Those born after December 3, 2004 will not be included in the NRC if any of the parents is a doubtful voter or a declared foreigner by a tribunal.

In the previous hearing, the court stood firm by its resolution to have the NRC list published by August 31.

The Bench also had said that it was not going into the report of NRC State Coordinator Prateek Hajela in which he mentioned leakage of information on it in the Assam Assembly and certain statements made by the Leader of the Opposition there and Santanu Bharali, legal adviser to Chief Minister Sarbananda Sonowal.

During the hearing, the Bench had been informed that provisions under the Citizenship (Amendment) Act had been applied for considering the individuals under the NRC.

The top court had said it would pass an order as to whether the inclusion of people under the NRC would be based on Section 3(1)(a), 3(1)(b) and Section 3(1)(c) of the Act.

Section 3(1)(b) says every person born in India on or after July 1, 1987, but before the commencement of the Citizenship (Amendment) Act, 2003 and either of whose parents is a citizen of India at the time of his birth shall be a citizen of India by birth.

Section 3(1)(c) provides that a person is a citizen by birth if born on or after the commencement of the Citizenship (Amendment) Act, 2003, and both of his parents are citizens of India or one of whose parents is a citizen of India and the other is not an illegal migrant at the time of his birth.

On July 23, the Supreme Court extended the deadline for publication of the final NRC in Assam by a month to August 31.

Bengaluru: All India Mahila Congress President Alka Lamba on Monday accused the BJP and JD(S) of being silent over the alleged sex scandal involving Hassan MP Prajwal Revanna and said the horrifying case of violence against women has shocked the nation.

"More than 3000 videos with hundreds of women being sexually harassed, violated and even brutalised by MP Prajwal Revanna over the past few years have shaken the conscience of Kannadigas and Indians alike," she told at a press conference here.

Prajwal (33) is grandson of JD(S) supremo and former Prime Minister H D Deve Gowda. JD(S) joined the NDA in September last year. He was the NDA candidate in Hassan Lok Sabha constituency, which went for polls on April 26.

According to police sources, he left the country after voting was over.

The Congress government in Karnataka on Sunday constituted a Special Investigation Team to probe the alleged sex scandal.

Some explicit video clips allegedly involving Prajwal had started making the rounds in Hassan in recent days.

Lamba said the horrifying case of sexual violence against hundreds of women has shocked the nation.

"These acts of sexual brutality against hapless women has revealed the depravity of MP Prajwal Revanna, but the silence and sheer apathy of the BJP and JDS in this horrendous case is absolutely shameful," she said.

She alleged that in these videos, some recorded against the consent of the victim, women are seen pleading to be spared but the MP continues to brutalise and sexually violate them. Party 'karyakartas', panchayat members, elderly women, women who came asking for help to him and even maids have not been spared.

"The horrible fact is, that the acts of this sexual predator MP Prajwal Revanna was endorsed by Prime Minister Narendra Modi as he campaigned in Old Mysuru Region on April 14th, 2024," she alleged.

"....the BJP JDS are still silent which shows you their true Anti Woman DNA!! Will the BJP or JDS answer?".

Bagalkot, Apr 29: Prime Minister Narendra Modi on Monday accused the Congress of planning religion-based reservation in the country for the sake of vote bank politics but asserted that he will not let it happen.

He said this Congress proposal is to appease minorities as the SC/ST and OBC community is now with the BJP.

"In Karnataka, Congress has started a campaign to change the Constitution and to snatch away the rights of SC/ST and OBCs. Our Constitution does not accept religion-based reservation. But the Karnataka government has given part of OBC reservation to Muslims," Modi said.

Addressing a mega election rally in this district headquarters town, he said, "They (Congress) will not settle with this. They had earlier too in their manifesto said about coming out with a law to provide religion-based reservation. There is a similar signal in their manifesto this time."

"I want to make my Dalit, SC/ST and OBC brothers and sisters aware about Congress' intentions. These people on the basis of religion, to keep their vote bank safe, are planning to loot your right which was given by Babasaheb Ambedkar and the Constitution," he added.

Veteran BJP leader B S Yediyurappa, BJP candidates and MPs from Bagalkot (Bagalkot) and Vijayapura (Bijapur) - P C Gaddigoudar and Ramesh Jigajinagi, respectively - were among those present at the rally.

Noting that most of SC, ST and OBC MPs in the Parliament are from BJP, Modi said, "So they feel that as SC, ST and OBC are with BJP. To gain the trust of minorities, they want to loot from SC, ST and OBC and give it to minorities. Will you let this happen?"

"I want to guarantee today to my Dalit, Adivasi and OBC brothers and sisters. I will not let such intentions of Congress be successful. To protect your rights, your reservation, Modi will go to any extent. I'm assuring you this," he added.

Campuses of several US Universities have been witnessing massive protests with the students seeking a ceasefire in Israel's war with Hamas. Police have arrested over 550 protesters and some universities are witnessing violent crackdown of protests by the ruthless cops. 

Law enforcement officials at the behest of college administrators have deployed tasers and tear gas against students protesters at Atlanta's Emory University, even though the protests have been largely peaceful, say activists and media personnel present at the spot.

Emil' Keme, professor of English and Indigenous studies, at the University said that the scene reminded him of the civil war in Guatemala as a teenager.

"Police immediately began to force people to move. I felt like I was in a war zone, with all the police and their weapons, the rubber bullets. We were pushed away," Mr Keme told the Guardian describing what happened as soon as cops entered the Emory campus.

“Police took the student next to me, pushed an older lady nearby and then pushed me.”

Student protesters say they are expressing solidarity with Palestinians in Gaza, where the confirmed death toll has topped 34,305, according to the Hamas-run territory's health ministry. They want universities to cut their investments in everything tied to Israel and weapons that fuel the war in Gaza. That means funds run by BlackRock, Google as well as Amazon's cloud service, Lockheed Martin and even Airbnb.

Video circulated widely on social media shows two women who identified themselves as professors being detained, with one of them slammed to the ground by one officer as a second officer then pushes her chest and face onto a concrete sidewalk.

Atlanta police and Georgia troopers are leading a joint operation within the campus to dismantle the tents and camps the activists have set up at the school's quadrangle. Within minutes of the authorities entering the campus, 28 people, 20 of whom were "Emory community members", had been arrested, the institute said in a statement.

The school president said that the videos of police clashing with the students "are shocking" and that he is "horrified horrified that members of our community had to experience and witness such interactions."

The university's response was likely the quickest show of police force in response to a divestment protest among the dozens nationwide that have occurred in recent weeks. It was also probably the only one where pepper balls, stun guns and rubber bullets were used.
