
The accused is 17-year-old Punith, who had been incarcerated in Mangalore jail since his arrest few months ago in connection with the attack on youth by a mob at a homestay in Padil last year.
According to his SSLC certificate, Punith's date of birth is September 25, 1995, and being a minor, he should have been tried by the Juvenile Justice Board. However, he had been locked up in Mangalore jail among adult under trials.
Speaking to Coastaldigest.com, chairperson of Child Welfare Committee (CWC) Asha Nayak said that it was a gross violation of civil rights.
“The matter of the accused being a minor was brought to our notice about a month ago, when the accused's sister approached the CWC. Being illiterate, other members of the family were ignorant of the laws dealing with juveniles. The situation being a violation of the Juvenile Justice Act, the letter written by the minor's sister was forwarded to the District and Sessions Judge,” she said adding that the family had furnished the minor's original SSLC certificate proving his age. “On verifying that the documents were genuine, the CWC went forward and filed an application for bail, which was sent to the Principal Civil judge,” she said opining that the age and other details of the accused should have been double-checked by the police long back and imprisoning him was “a violation of civil rights” as every juvenile was entitled to bail.
