Dalit pressure forces HDK govt to seek legal opinion over promotion quota ahead of bypolls

Bengaluru, Oct 17: In the wake of veiled threats by Some Dalit organizations against ignoring promotion quota, the chief minister H D Kumaraswamy led JD(S)-Congress coalition government has sought opinion over implementing a legislation providing reservation in promotion for Scheduled Castes and Scheduled Tribes employees.

The development comes ahead of bypolls to three parliamentary and two legislative assembly constituencies in Karnataka.

While the Supreme Court is set for a final hearing on the issue next week, the government, sources said, has been under pressure from SC/ST employees association, which is seeking implementation of the Karnataka Extension of Consequential Seniority to Government Servants Promoted on the basis of Reservation (to the posts in Civil Services of the State) Act, 2017, which came into force in June this year.

Recently, a delegation led by D Shivashankar of the SC/ST Employees’ Association had met Kumaraswamy in Ramanagara to urge him to fulfil the promise or face the ire of Dalits in the bypolls.

“Though the Congress was instrumental in introducing the Bill to protect SC/ST government employees, JD(S) is not showing the same zeal in implementing it. Dalits are very upset and it could have a bearing on the prospects of Congress candidates in some constituencies, since the BJP is expected to take advantage of it,” said N A Govindappa, state president of the federation of Backward Classes, Minorities and Dalits (Ahinda).

However, JD(S) and Congress leaders said there will be no differences between their parties over the issue. “We are equally committed to implementing the SC/ST promotion Bill and are waiting for bypolls to get over. Our target is to defeat the BJP and nothing else will come between,” a senior JD(S) minister said, without wanting to be dragged into the issue.

In the recent assembly polls, sources said the voting pattern clearly suggested that BJP had immensely benefited from the SC/ST community, especially in central Karnataka, where they won a record number of seats.

Opposition

Meanwhile, Ahimsa, the organisation that represents general category, backward classes and minority employees, has approached the Election Commission on Tuesday and submitted a memorandum to Chief Electoral Officer, urging the commission not to allow implementation of the Act since the model code of conduct is in place.

“SC/ST Ministers and officials are wrongly interpreting the court order and urging the government to implement the Act. The action of the government is illegal. Government may take action to woo the SC/ST voters for their parties during this byelections,” the memorandum said.

A similar memorandum has been submitted to the Chief Minister and the Chief Secretary.

According to a Ahimsa functionary, the government can wait till the court order. “What is the hurry to implement the act without the permission of the court? We have told the government that we will resort to non-cooperation if the act is hurriedly implemented,” the functionary said.

When contacted for his reaction, Chief Electoral Officer Sanjiv Kumar said: “Normally no new policy decision can be implemented during the electoral process. However, court orders can be implemented. I have not seen the memorandum yet and I cannot comment on this particular issue.”

Hassan MP and Lok Sabha election candidate of the BJP-JD(S) alliance Prajwal Revanna, who is facing an inquiry over the alleged sexual abuse of several women, said the truth will prevail.

The MP, who left the country as soon as the election to his constituency ended, has also sought seven days' time to appear before the Special Investigation Team (SIT) formed by the Karnataka government to inquire into the huge cache of about 3,000 explicit videos and photos allegedly pertaining to him, which have gone viral on social media.

“As I am not in Bangalore to attend the enquiry, I have communicated to CID Bangalore through my advocate. Truth will prevail soon,” Prajwal, grandson of former prime minister and JD(S) patriarch H D Deve Gowda, said in a post on X.

A case has been registered against MLA and former minister H D Revanna and his son Prajwal at Holenarasipura on a complaint lodged by their former cook and relative for allegedly sexually harassing her.

She also alleged that Prajwal made video calls to her daughter and spoke in an objectionable manner, which forced her to block him.

The MP who is seeking re-election from Hassan on a JD(S) ticket, shared a letter by his lawyer Arun G to the Deputy Superintendent of Police of the SIT, in which he has sought seven days' time to appear before the official because he is abroad.

Bagalkot, Apr 29: Prime Minister Narendra Modi on Monday accused the Congress of planning religion-based reservation in the country for the sake of vote bank politics but asserted that he will not let it happen.

He said this Congress proposal is to appease minorities as the SC/ST and OBC community is now with the BJP.

"In Karnataka, Congress has started a campaign to change the Constitution and to snatch away the rights of SC/ST and OBCs. Our Constitution does not accept religion-based reservation. But the Karnataka government has given part of OBC reservation to Muslims," Modi said.

Addressing a mega election rally in this district headquarters town, he said, "They (Congress) will not settle with this. They had earlier too in their manifesto said about coming out with a law to provide religion-based reservation. There is a similar signal in their manifesto this time."

"I want to make my Dalit, SC/ST and OBC brothers and sisters aware about Congress' intentions. These people on the basis of religion, to keep their vote bank safe, are planning to loot your right which was given by Babasaheb Ambedkar and the Constitution," he added.

Veteran BJP leader B S Yediyurappa, BJP candidates and MPs from Bagalkot (Bagalkot) and Vijayapura (Bijapur) - P C Gaddigoudar and Ramesh Jigajinagi, respectively - were among those present at the rally.

Noting that most of SC, ST and OBC MPs in the Parliament are from BJP, Modi said, "So they feel that as SC, ST and OBC are with BJP. To gain the trust of minorities, they want to loot from SC, ST and OBC and give it to minorities. Will you let this happen?"

"I want to guarantee today to my Dalit, Adivasi and OBC brothers and sisters. I will not let such intentions of Congress be successful. To protect your rights, your reservation, Modi will go to any extent. I'm assuring you this," he added.

New Delhi: The Aam Aadmi Party on Saturday alleged that Delhi Chief Minister Arvind Kejriwal is being pushed towards a “slow death” inside Tihar jail by denying him insulin and consultations with his doctor.

Kejriwal, who has Type-2 diabetes, has been asking for insulin and a video conferencing with his family doctor but his requests are being denied by the jail administration, party spokesperson Saurabh Bharadwaj said in a press conference.

"I want to say with full responsibility that a conspiracy is underway for the slow death of Kejriwal," Bharadwaj claimed citing blood sugar readings of the Chief Minister in jail.

He also slammed the Tihar administration, BJP, Centre and Delhi LG for allegedly denying insulin to Kejriwal and said the Delhi Chief Minister had been suffering from diabetes for the last 20-22 years.

On Friday, the chief minister council Senior advocate Abhishek Singhvi said Kejriwal has not been administered insulin to control his sugar levels since his arrest, terming it “shocking” and “alarming”.

The ED had on Thursday claimed before the court that Kejriwal was eating food high in sugar like mangoes and sweets every day, despite having Type-2 diabetes, to create grounds for medical bail.

Kejriwal, however, refuted the ED’s claims by asserting before a court that the food he consumed was in conformity with the diet chart prepared by his doctor.

“Out of 48 meals sent from home, only three times mangoes were there…,” Singhvi told the court.

Bharadwaj said Kejriwal was allowed by the court to use a machine in the jail to monitor his daily blood sugar levels.

"Overall, it was a conspiracy to finish Kejriwal so his multiple organ damage and when he comes out of jail after 2-4 months he goes for treatment of kidney, heart and other organs," said Bharadwaj, who holds the portfolio of health in Delhi government.
