Karnataka HC stops arrest of Aaj Tak’s Sudhir Chaudhary in ‘communal hatred’ case

Bengaluru, Sept 15: The Karnataka High Court has directed the police not to take precipitative action against Aaj Tak news channel's Consulting Editor Sudhir Chaudhary in an FIR filed against him, but said that there was a prima facie case against him, and it should be investigated. The court also said that it would dispose of the petition filed by Chaudhary challenging the FIR and that there was no need for custodial interrogation till then.

The interim order sought by Chaudhary for stay was not granted as the HC ordered the petition to be posted for hearing on September 20. Chaudhary had challenged the FIR lodged at the Seshadripuram police station in Bengaluru after a complaint by Shivakumar S, the Assistant Administrative Officer of the Karnataka Minorities Development Corporation Limited. The single judge bench of Justice Hemant Chandangoudar who heard the petition observed during the hearing that there was a prima facie case for investigation.

“The specific allegation was that the government is providing a scheme only to minorities and depriving Hindus. There is a prima facie case for investigation,” the HC said. Senior counsel Uday Holla argued the case for Chaudhary. The HC said that the scheme established for minorities by the Minority Development Corporation can be criticised by any person including the media but the case against Chaudhary -- “whether the allegations that news item telecasted by petitioner satisfies essentials of Section 153A IPC (promoting enmity between different groups on grounds of religion, race, place of birth, residence, language, etc., and doing acts prejudicial to maintenance of harmony) -- needs to be examined.” However, in relief for Chaudhary, the HC has said there won't be any custodial interrogation or arrests. “Till Tuesday (Sep 19) don't take any precipitative action. I am going to hear the matter. This matter is to be disposed of. I cannot keep it pending. I need time to hear the matter till Tuesday,” the court said, adjourning the hearing.

Holla argued that the scheme was only for minorities. The HC however pointed out that it was not what was telecast on the news channel. “The average man may develop hatred towards minorities saying they have been given and not me,” observed the HC, which also pointed out the claim in the news report that said “84 per cent (of beneficiaries) come from a specific minority community.” Chaudhary has been booked under Section 153A (promoting enmity on grounds of religion) and other sections of the Indian Penal Code (IPC). The complaint had alleged that Chaudhary had conspired to disrupt communal harmony by spreading misinformation on his channel about the Karnataka government’s 'Swavalambi Sarathi Scheme'.

The scheme provides 50 per cent subsidy on bank loans obtained by religious minorities for purchase of commercial transport vehicles up to ₹three lakh. It was alleged that Chaudhary in a news programme on Aaj Tak channel spread misinformation about the government practicing minority appeasement.

Mangaluru, June 10: The National Investigation Agency (NIA) has arrested another prime accused in 2022 BJP Yuva Morcha worker Praveen Nettaru murder case. 

32-year-old Jilla BJP Yuva Morcha committee member Nettaru was hacked to death in front of his broiler shop in Bellare of Dakshina Kannada by bike-borne miscreants in July 2022. The case is being investigated by the NIA and several arrests have been made so far.

Mustafa Paichar, accused number four in the case, was absconding after the murder and the NIA had declared a Rs 5 lakh reward to catch him. 

He was arrested at Sakleshpur in Hassan district by the NIA team led by Inspector Shanmugam. 

According to officials Mustafa was reportedly a member of now banned Popular Front of India and a resident of Shantinagar in Sullia in Dakshina Kannada.

Mangaluru: Dakshina Kannada Zilla Panchayat High School in Harekala, popularly known as Padma Shri awardee Harekala Hajabba’s school, is gearing up to inaugurate its first batch of Pre-University (PU) courses starting June 1. 

The government issued an order to elevate the school established by Padma Shri awardee Harekala Hajabba to the status of a PU College a few months ago.

The School Education and Literacy Department (PU Education) has formally sanctioned the upgrade for the school.

CD Jayanna, the deputy director of PU Education, confirmed that all necessary approvals have been obtained from the government to initiate PU classes.

“Hajabba’s school will kick off PU classes for its inaugural batch on June 1. We have appointed a senior lecturer as the interim principal for the PU college. Presently, the school possesses the essential temporary infrastructure to begin the I PU batch. Plans are underway to enhance the infrastructure for the PU college in the future. Currently, the school boasts adequate classrooms and facilities to commence PU classes,” stated Jayanna.

Harekala Hajabba, an orange vendor, personally erected the school in his native village, New Padpu in Harekala, situated approximately 35 km from Mangaluru. For several years, he has tirelessly petitioned the government for the establishment of a PU college.

Expressing his gratitude, Hajabba mentioned that 19 students who recently completed their SSLC examinations are poised to enroll in the new PU college. He added, “We anticipate enrollment from neighboring villages as well. Both the interim principal and the PU education department have been diligently orchestrating the necessary arrangements to initiate classes.” 

He extended his appreciation to the government, local representatives, and officials for their unwavering support.

Madikeri: A 15-year-old was bludgeoned to death and the accused fled with her severed head at Mutlu village in Somwarpet of Kodagu district on Thursday late night, hours after her SSLC examination result was declared.  

The victim has been identified as US Meena, a 10th grade student of Surlabbi High School. She had passed the SSLC examination and her school attained 100% results. 

However, she was brutally murdered by accused Prakash (32), a resident of the village. The police have launched a search operation to find the suspect, said Kodagu SP K Ramarajan 

It is said that the minor girl's engagement with the suspect was thwarted by officials from Women and Child Development department on May 9, and later officials had even convinced her parents of not to marry the minor girl.

However, the suspect barged into her house in the night and allegedly kidnapped her. Later, he took her to an area near the periphery of the forest and murdered her after which he fled with her severed head.

Victim's mother too has suffered injuries and is admitted to a hospital for treatment. The reason for the murder will be known after the probing officials have inquired the victim's mother, said the SP.
