A bench of Justices H L Gokhale and J Chelameswar issued notice to the State government after advocates Prashant Bhushan and Haris Beeran, representing Ma'adani, the founder of People's Democratic Party in Kerala, submitted that he required urgent medical treatment for multiple ailments.
They submitted that the petitioner had been in jail in the case since August 2010, after spending more than nine years behind bars in another case relating to Coimbatore blasts in which he was acquitted.
So far, as many as 70 of the total 550 witnesses listed in the case have been examined, but none of them has talked about his role, Bhushan contended.
He said Ma'adani was wheel-chair bound and had virtually lost his eye sight. Since the petitioner has been provided B-category security in Kerala, his movement would always remain under constant watch even after he gets bail.
The matter has been posted for further hearing to October 21.
