
According to the document obtained through RTI, Cheluvarayan Swamy and H D Kumaraswamy, who won in the 2009 Lok Sabha polls from Mandya and Bangalore Rural constituencies respectively, had resigned from their seats after being elected to the Assembly in May 2013.
By-polls to Mandya and Bangalore Rural Lok Sabha seats were held on August 21, 2013, on account of which, the state government was forced to incur an additional expenditure of Rs 4, 40, 62,668.
In the PIL, Mr Kabeer has demanded that the candidates resigning from their posts should be banned from contesting for any elections for a minimum period of 10 years.
The PIL also demanded that no candidates should be permitted to contest from two seats simultaneously.
Currently, there is no law which restricts a candidate who has resigned from his/her post from contesting in another election.
