
The Court has said that in case the convict fails to fulfill the term, then his imprisonment may be extended by two years. The amount will be payable to the victim, as per the Court order.
The convicted is Roopesh alias Roopesh Devadiga alias Prashanth (25) of Gandottu Mane, Mucchur. In 2010, Roopesh had raped a 17-year-old college girl near Mucchur.
Background
A 17-year-old student (when the incident occurred), residing at Mucchur near Kateel was studying in II PUC in a college in Kinnigoli.
Her routine was to carry milk from home and delivery it at the dairy, leave the milk cans at a shop nearby and then board a bus to college.
On December 10, 2010, the girl on returning from college, came to the shop to pick the milk cans and as she was on her way back home, at 4.15 pm, she was waylaid by Roopesh at Thakarakodi, who seized the opportunity and raped her. A case was registered at Bajpe police station.
During the hearing Public Prosecutor argued that rigorous imprisonment must be given to the accused in this case since the crime has been meted on a minor girl hailing from a extreme rural background, who had nurtured dreams of studying in the College fighting all odds.
The lawyer arguing for Roopesh highlighted that the accused too is very young and after serving jail for a year, he was released on bail and since then he has been prompt and co-operative in the proceedings of the investigation, without missing even a single hearing. Hence the Court should consider his behaviour too while pronouncing verdict.
What can be noted is that the minimum punishment in his particular case can be 7 years of imprisonment and the Court has pronounced 8 years of imprisonment to the convict, said Public Prosecutor Manjunath V Bhat calling it a triumph.
