A bench of Justices H L Gokhale and J Chelameswar also allowed Ma'adani's wife to remain by his side when he undergoes eye surgeries. Advocates Prashant Bhushan and Haris Beeran, representing Ma'adani, sought bail for him, claiming that he required urgent medical treatment due to multiple ailments. They claimed that the petitioner had virtually lost his eye-sight.
The Karnataka government, which was earlier issued a notice by the apex court, sought two weeks further time to file its response to his bail application.
Meanwhile, the court also issued a notice to Kerala government on his petition. According to his counsel, since Ma'adani has been provided B category security in Kerala, his movement would always remain under constant watch, if he was enlarged on bail.
They submitted that the petitioner has been in jail in the case since August 2010, after spending more than nine years behind the bars in a case relating to Coimbatore blasts in which he was acquitted later.
So far, as many as 70 of the total 550 witnesses listed in the case have been examined but none of them have spoken about his role in the case, they contended.
