Complaint filed against BSY in land scam, SC informed

New Delhi: Nov 26: A complaint filed against former Karnataka Chief Minister B S Yeddyurappa for action in land scam cases is coming up for consideration before a trial court on November 30. Sirajin Basha, an advocate, who approached the Supreme Court against an order quashing the sanction by previous Karnataka Governor H?R?Bhardwaj for prosecution of Yeddyurappa, informed a bench of Justices J Chelam-eswar and P C Pant that he has already filed his complaint before the trial court.

The bench, which was initially inclined to dispose of his pending special leave petition, however, adjourned the matter for four weeks on a request by advocate Prashant Kumar on behalf of Sirajin Basha.

The counsel submitted that the issue before the apex court still survived and required consideration as Bhardwaj's predecessor also declined sanction for the senior BJP leader's prosecution.

He said that under the Prevention of Corruption Act, sanction was not required but under the Indian Penal Code, it was still required for the purpose, Kumar submitted. The bench then posted the matter after four weeks.

The Supreme Court on August 22 had asked the petitioner why he did not approach the trial court following subsequent development as Karnataka Governor Vajubhai Vala declined permission for launching criminal proceedings against Yeddyurappa.

Conflicting viewsAs the petitioner had then submitted that there were conflicting views taken by the two Constitutional authorities (Bhardwaj and Vala), the bench had asked him to show his bona fide and approach the trial court to proceed for offences under the IPC.

Basha had challenged the Karnataka High Court order of the November 2015, which had quashed the sanction by the previous Governor for prosecution of Yeddyurappa.

K N Balraj, a co-complainant, had on February 19, 2016 filed the petition in the high court after Vala had declined the request on December 4, 2015.
