Cops invoke non-bailable section against Prasad Attavar; court grants him interim bail

Mangaluru, Sep 3: Within a few hours after his arrest on Thursday, Prasad Attavar, the chief of Rama Sene, a fringe outfit, was granted interim bail by the judge of JMFC II court even though the Mangaluru City police had invoked Section 153 (a), a non-bailable section of the Indian Penal Code, and Section 506 (criminal intimidation) against him for making comments threatening the life of rationalist Prof. KS Bhagwan.

The development comes three days after Bhuvith Shetty, a Bajrang Dal activist, who made similar comments on his Twitter account, was arrested on August 31. The police had invoked Section 153 (wantonly giving provocation with intent to cause riot) and Section 506 and produced Shetty before a local magistrate, who granted him bail on the same day. This led to criticism of the police action.

According to a senior police official, after Attavar’s arrest, they held a consultation with legal experts and those in the Department of Prosecution. This led to invoking of section 153 (a) against Attavar.

However, Attavar has denied making any such comment on his Facebook page. He has told reporters that the Facebook page ‘Jai Bajarangi’, in which the alleged comments were seen, was created using a fake account using his photo. “When I do not know who M.M. Kalburgi was, there is no question of making any such comment,” he claimed.

Attavar, who now runs a private security agency, was with the Bajrang Dal for nearly eight years. Following the June 2005 attack on employees of a sari shop belonging to different communities, who were going on a trip, there was a division in the Bajrang Dal, and Sri Rama Sene was formed. Attavar became its district unit president.

It was during his time that the Sene activists assaulted men and women at a bar near Jyothi Circle on January 24, 2009. Attavar was arrested and named as accused in the case. Attavar was removed from the sene following his arrest for alleged association with underworld operative Ravi Poojary in March 2010. Following his release on bail, Attavar has floated the Rama Sena organisation.

Udupi, Dec 15: What was meant to be a post-pilgrimage gathering turned tragic in Padukere village of Brahmavar taluk, Udupi district, late Sunday night, when a clash among youths escalated into a fatal assault, leaving one man dead.

The victim has been identified as 30-year-old Santosh Mogaveera, a resident of Padukere.

According to preliminary information, the incident took place during a late-night drinking party involving a group of local youths who had recently returned after completing their pilgrimage to the Sabarimala shrine. An argument reportedly broke out among the group and soon escalated into a violent confrontation.

During the ensuing brawl, Santosh Mogaveera was allegedly assaulted and collapsed at the spot after sustaining serious injuries. He was rushed by local residents to a private hospital in Brahmavar, where doctors declared him dead.

On receiving information, senior police officials, including Brahmavar Circle Inspector Gopikrishna, Kota Police Sub-Inspector Praveen Kumar T, Station ASI Manthesh Jabagoudar, and head constables Pradeep and Ashok, visited the spot and conducted an inspection.

Police have taken four youths into custody in connection with the incident. A case has been registered at the Kota police station, and further investigation is underway to ascertain the exact sequence of events leading to the death.
