Court dismisses bail plea of Aloysius priests in house demolition case

Mangalore, Jul 16: The Second Additional Sessions Judge, Mangalore, has dismissed an anticipatory bail application filed by two priests of St Aloysius College, Mangalore–Fr Cyril D'Mello and Fr Francis D Almeida–both of whom are the principal accused in the case of illegally demolishing a house.

It could be recalled here that on June 26, the above two priests, along with the Rector Fr Denzil Lobo and their lawyer M P Noronha brought a JCB and demolished the residential house in which John Baptist Lewis and his daughters were residing since decades and the family has been on the streets since that date.

A group of over 40 persons who included anti-social elements and students of the college physically manhandled the old man and his young daughters and demolished the structure burying everything that belonged to them in the debris after taking away all the original documents which belonged to Lewis. Even though the dispute was subjudice before the Civil Court, the priests resorted to the extreme step.

The police have only arrested the JCB driver and the three workmen and the Sessions Court has refused to release them on Bail through the order passed on Tuesday.

The police have so far failed to arrest the two main accused, who after a period of two weeks, applied for anticipatory bail. Their application was strongly opposed by justice M F Saldanha who has taken up the case in the public interest.

In his affidavit, he pointed out to the Court that these priests have not only acted high handedly and illegally but that they have been using their money power and influence to avoid arrest. It is demonstrated that they have no respect for the law or for the pending cases or for the Court(s) and that they have committed Contempt of Court and are disqualified from any relief.

Justice Saldanha also pointed out to the Court that these are serious offences in which bail cannot be granted and that their arrest and custodial interrogation is essential to trace out and prosecute the remaining 40 persons who had participated in the offence, one of whom is the vice principal of the college, who is also absconding.

The court upheld these contentions and dismissed the anticipatory bail application filed by the priests.

Meanwhile, in a strongly worded notice, addressed to the Police Commissioner, Justice Saldanha has pointed out that this incident which has sent shock waves in the public mind indicates a total breakdown of law and order and that after latest court order, the police must arrest all the accused persons immediately.

India is currently polling in the Lok Sabha elections, and AI-generated videos that spread disinformation have emerged as a major threat. As per a report, Meta approved several political advertisements manipulated by Artificial Intelligence that spread disinformation during Lok Sabha elections 2024.

Facebook reportedly approved ads that contained slurs towards Muslims in India like “let’s burn this vermin” and “Hindu blood is spilling, these invaders must be burned” along with disinformation about political leaders and other messages with Hindu supremacist language.

Another advert approved by the owner of Facebook and Instagram called for an opposition leader's execution who as per a false claim sought to “erase Hindus from India”. This ad contained the image of a Pakistan flag alongside the message.

The report comes at a time when the social media platform X had to recently take down an animated video shared by the Karnataka unit of the BJP after an Election Commission direction.

India Civil Watch International (ICWI) and Ekō, a corporate accountability organisation created and submitted these adverts to Meta's ad library to test the company's mechanism to detect and block harmful political content.

All adverts “were created based upon real hate speech and disinformation prevalent in India, underscoring the capacity of social media platforms to amplify existing harmful narratives," the report mentioned.

The researchers submitted 22 adverts to Meta in English, Hindi, Bengali, Gujarati, and Kannada, of which 14 were approved. Another three were approved with small tweaks. However, once approved, the researchers immediately removed the ads before their publication.

The research concluded that Meta failed to detect the presence of AI-manipulated images in all of the approved ads.

While five of the adverts, including one with some allegations against PM Modi were rejected on charge of breaking Meta's policy on hate speech, the report noted that the 14 others approved targetted Muslims and “broke Meta’s own policies on hate speech, bullying and harassment, misinformation, and violence and incitement."

“Supremacists, racists and autocrats know they can use hyper-targeted ads to spread vile hate speech, share images of mosques burning and push violent conspiracy theories – and Meta will gladly take their money, no questions asked,” the Guardian quoted Maen Hammad, a campaigner at Ekō as saying.

In response, Meta clarified that they require advertisers to disclose their use of AI.

“When we find content, including ads, that violates our community standards or community guidelines, we remove it, regardless of its creation mechanism. AI-generated content is also eligible to be reviewed and rated by our network of independent factcheckers – once a content is labeled as ‘altered’ we reduce the content’s distribution. We also require advertisers globally to disclose when they use AI or digital methods to create or alter a political or social issue ad in certain cases," the company said in response.

Meanwhile, Meta has been accused in the past of failing to curb Islamophobia on its platforms.

“This election has shown once more that Meta doesn’t have a plan to address the landslide of hate speech and disinformation on its platform during these critical elections,” Hammad said questioning how one can trust Meta if it fails to detect even a handful of AI-generated images.

Bengaluru: JD(S) patriarch and former Prime Minister H D Deve Gowda on Thursday issued a 'stern warning' to his grandson and suspended party MP, Prajwal Revanna, asking him to return to the country and face probe into sexual abuse allegations, while asserting there will be no interference from him or other family members into the enquiry.

He asked Prajwal, the party's Hassan MP who is facing allegations of sexual harassment of many women, to return to India and surrender before the police. Prajwal had flown reportedly to Germany in the last week of April.

The JD(S) supremo reiterated that his grandson should be given the harshest punishment under the law "if found guilty".

"At this juncture, I can do only one thing; I can issue a stern warning to Prajwal and ask him to return from wherever he is and surrender before the police. He should subject himself to the legal process," the 92-year-old veteran politician said in a statement on X (formerly Twitter).

Gowda made it clear it was "not an appeal that I am making, it is a warning that I am issuing".

"If he does not heed this warning, he will have to face my anger and anger of all his family members. The law will take care of the accusations against him, but not listening to the family will ensure his total isolation. If he has any respect left for me, he has to return immediately," Gowda said.

"I wish to also make it clear that I will ensure that there will be no interference in the enquiry against him from me or my family members. There is no emotion in this regard in my mind whatsoever, there is only the cause of justice for those who have suffered as a result of his alleged actions and misdeeds," the former PM added.

He recalled he had spoken to the media about Prajwal Revanna on May 18.

"It took me some time to recover from the shock and pain he (Prajwal) has inflicted on me, my entire family, my colleagues, friends and party workers. I have already said he should be given the harshest punishment under the law if found guilty," the nonagenarian leader said.

Stating that he was aware that people had spoken 'harshest' words against him and his family in the last few weeks, apparently over the issue, Gowda said he would not wish to stop them, criticise them and argue with them saying "that they should have waited until all the facts were found out".

He also cannot convince people that he was unaware of Prajwal's activities, or that he has no desire to shield him, unaware of his movements, and also about his foreign trip.

"I believe in answering to my conscience. I believe in God and I know the Almighty knows the truth," the JD(S) patriarch said.

He also opted "not to comment on political conspiracies, exaggerations, provocations and falsehoods that have been maliciously spread in recent weeks."

"I am very sure people who have done it will have to answer to God and pay for it heavily one day. I place my truth and my burdens at the feet of the Lord," he said.

The former Prime Minister underlined that it was of utmost importance for him to earn back the trust of the people.

"It is of utmost importance to me to earn back the trust of the people. They have stood by me for over 60 years of my political life and I am deeply indebted to them. As long as I am alive, I will never let them down," he said.

Prajwal, who is seeking re-election from Hassan as an NDA candidate, is absconding and is holed up abroad ever since a huge cache of explicit videos become public, showing women being sexually assaulted allegedly by him.

There are two rape cases registered against Prajwal. An arrest warrant has also been issued against him besides a blue corner notice by the Interpol.

Karnataka Chief Minister Siddaramaiah has written to the Centre to cancel his diplomatic passport.

Prajwal’s father and Holenarasipura MLA H D Revanna is out on bail in two cases. One is related to molestation of a cook, who was also allegedly raped by Prajwal, and the other relates to the kidnap of a woman.

Mangaluru: To prevent tragic incidents during the rainy season, Home Guards will be stationed at beaches in Dakshina Kannada starting June 1, announced District Home Guard Commandant Dr. Murali Mohan Choontharu.

During visits to Sasihithlu and Surathkal beaches, Dr. Choontharu provided guidance and suggestions to the home guards on flood rescue operations. He emphasized the importance of these measures in ensuring public safety during the monsoon season.

Deployment Period: June 1 to September 30

Beaches Covered:

Someshwar

Mogaveerpatna

Ullal

Panambur

Tannirbhavi

Fathima Beach

Surathkal

Sasihithlu

Two home guards will be stationed at each beach, working in shifts from 7 am to 7 pm. This ensures continuous monitoring and quick response to any emergencies that may arise.

Preparedness and Coordination

Dr. Choontharu highlighted that the sea conditions are particularly hazardous during the monsoon, with high waves posing significant risks to unaware tourists. The presence of beach guards aims to mitigate these dangers and prevent loss of life.

The home guards will work in close coordination with the Police Department and Fire and Emergency Services to enhance disaster management efforts across the district.

Additionally, a reserve team of 10 home guards will be on standby at the district Home Guard office to respond to emergency calls during the monsoon.
