SC upholds ban on hijab, full sleeves in pre-medical test; turns down SIO’s plea

New Delhi, Jul 25: The Supreme Court of India declined to allow the girls to follow the full body-covering dress code during All India Pre-Medical Test asking Muslim girls and Students Islamic Organization of India (SIO) to follow the bizarre code prescribed by CBSE this time.

Buoyed by the Kerala high court's recent order allowing two Muslim girls to wear head scarf and full sleeve shirts during examination, SIO and the students had requested the SC to grant similar relaxation to all Muslim girls during AIPMT by permitting them to wear full-sleeved dress with head scarf.

Appearing for them, senior advocate Sanjay Hegde said, "It is a matter of religious belief. Muslim women and girls are required by religion to be attired in full-sleeve clothing and scarf whenever they appear in public. If the relaxation in dress code is not granted, these Muslim girls may have to drop out of the examination."

The bench said: "The CBSE has come out with a dress code for the sake of keeping the examination fair and proper. It is a matter of three hours. You observe the dress code mandated by the CBSE for three hours and then wear the scarf as long as you want."

"This is an examination. If during the examination you do not tie the scarf, you would not be committing a sin. No discourtesy will be shown to the religion if you appear in the examination without a scarf. You go and appear in the test and don't waste time in the court," the bench said.

AIPMT was cancelled by the SC following allegations of large-scale cheating by students. To prevent a repeat, CBSE had issued an examination dress code for students making it difficult for them to hide chits or gadgets.

The CBSE notification prohibiting 'scarfs', 'hair pin' and 'hair band' as well as mandating all students to wear half-sleeved clothes without big buttons was termed by petitioners as 'anti-Islamic'. "If the above portions of the notification of CBSE are enforced, the petitioners will not be in a position to sit for the AIPMT scheduled for July 25 and would also amount to violation of their right to freedom of religion," the petition said.

A bench of Chief Justice H L Dattu and Justices Arun Mishra and Amitava Roy said this argument — "allow me to wear the dress dictated by religion otherwise I would not appear in the examination" — was "nothing but an ego issue".

Hegde said the students were ready to come to the examination Centre an hour before the scheduled time to subject themselves to a thorough check by women invigilators. But the bench asked: "If all the students come dressed similarly, how would the invigilator examine their religion and determine whether they were entitled to claim relaxation in dress code?"

The CJI said the SC has on administrative side passed an order saying no one would enter the court rooms with a cap or hat on. "Can a person violate it saying he belonged to a particular religion," he asked. Finding the going tough, Hegde sought permission to withdraw the petition. The court dismissed it as withdrawn.

Hassan MP and Lok Sabha election candidate of the BJP-JD(S) alliance Prajwal Revanna, who is facing an inquiry over the alleged sexual abuse of several women, said the truth will prevail.

The MP, who left the country as soon as the election to his constituency ended, has also sought seven days' time to appear before the Special Investigation Team (SIT) formed by the Karnataka government to inquire into the huge cache of about 3,000 explicit videos and photos allegedly pertaining to him, which have gone viral on social media.

“As I am not in Bangalore to attend the enquiry, I have communicated to CID Bangalore through my advocate. Truth will prevail soon,” Prajwal, grandson of former prime minister and JD(S) patriarch H D Deve Gowda, said in a post on X.

A case has been registered against MLA and former minister H D Revanna and his son Prajwal at Holenarasipura on a complaint lodged by their former cook and relative for allegedly sexually harassing her.

She also alleged that Prajwal made video calls to her daughter and spoke in an objectionable manner, which forced her to block him.

The MP who is seeking re-election from Hassan on a JD(S) ticket, shared a letter by his lawyer Arun G to the Deputy Superintendent of Police of the SIT, in which he has sought seven days' time to appear before the official because he is abroad.

Bengaluru, May 2: Prajwal Revanna, grandson of former Prime Minister Deve Gowda, was issued fresh summons on Thursday by the Special Investigation Team (SIT) which is investigating the case of obscene videos involving the former JD(S) member, several news outlets reported.

The SIT also junked his appeal which sought seven days time to join the probe, as per these reports.

Prajwal and his father, H D Revanna, have sexual harassment and stalking cases filed against them over the matter. Gowda's son, H D Revanna, however, said that what took place '4-5 years ago' is now being turned into a legal case.

JD(S) in its core committee meeting suspended Prajwal from the party till the end of the probe. Prajwal, meanwhile, took to X to state he would join the probe in seven days time, asserting 'truth will prevail'.

Mangaluru: BJP candidate in Dakshina Kannada Capt Brijesh Chowta has received a letter from Prime Minister Narendra Modi wishing him victory in the election.

In the letter, which the BJP shared with the media, the PM has lauded Chowta’s exceptional services in the armed forces as a part of the Gorkha regiment, especially in counter-insurgency operations. Modi also has mentioned about Chowta’s efforts as an organiser of the Mangaluru Lit Fest and his dedication to preserve the cultural heritage of the region.
