Should man freed in rape case be called a rape survivor: Court

New Delhi, Nov 3: There is a need to decide whether a person acquitted of the rape charge should be addressed as a "rape case survivor" like the victims in such cases, a Delhi court has said while acquitting a man in a case.

Additional Sessions Judge Nivedita Anil Sharma made the observation while acquitting a Delhi resident after the alleged victim retracted and turned hostile in the case.

"In the present case, the accused has been acquitted of the charge of rape as the prosecutrix retracted and turned hostile. In the circumstances, such a person, an acquitted accused, who has been acquitted honourably, should he now be addressed as a rape case survivor?

"This leaves us with much to ponder about the present day situation of the veracity of the rape cases," the judge said.

The court also noted that today there is a public outrage and a hue and cry is being raised everywhere that courts are not convicting the rape accused, "however, no man, accused of rape, can be convicted if witnesses do not support prosecution case or give quality evidence".

According to the police, in June last year, the accused had allegedly repeatedly raped the complainant for about four months while threatening to kill her children. He had also allegedly committed theft of ornaments and Rs two lakh cash from her in-laws house.

The accused was later arrested and charges were framed against him under sections 376 (rape), 380 (theft in dwelling house) and 506 (criminal intimidation) of IPC, it said.

During the trial, however, the woman changed her statement and said she had not made any rape complaint against him and prayed before the court to release him from jail and acquit him of the charges.

Mangaluru: The Mangaluru CEN police have arrested a 23-year-old man for allegedly posting provocative and misleading content on an Instagram page named “mr_a_titude”, targeting the Bajpe police.

Mangaluru Commissioner of Police Sudheer Kumar Reddy C H identified the arrested as Abhishek M, a resident of Katipalla in Mangaluru.

A case has been registered at the Bajpe Police Station under Sections 353(1)(c), 353(2), 56, and 57 read with Section 189 of the Bharatiya Nyaya Sanhita (BNS) in connection with the post.

According to police, the accused uploaded a photograph of a hotel on the Instagram page and alleged that accused persons in a murder case under the Bajpe police jurisdiction were being given “royal treatment” by the police, including being served beef meals daily from the hotel.

The post further accused the police of supporting criminals, misusing their authority, and betraying public trust. Police said the content was provocative in nature and aimed at inciting public outrage against the police.

Following the post, a case was registered at the Bajpe police station, and further investigation was transferred to the CEN police station.

Police records indicate that the accused has a criminal history, with multiple cases registered against him, including murder, attempt to murder, assault, and robbery at the Surathkal Police Station, and one case at the Kaup Police Station.

The Commissioner said the accused was traced and arrested using technical evidence.
