Mangalurue, Dec 2: In a major relief to Dakshina Kannada Superintendent of Police Dr Sharanappa, the Supreme Court has nullified the suspension order passed by Karnataka High Court earlier this year against him and two other police officers in a civil case related to the construction of a temple at Ujire.

Keeping officers under suspension was the domain of disciplinary authority and this should not have been exercised by the High Court Judge in exercise of the power under Section 482 of the Criminal Procedure Code, the order stated.
On a petition filed by Shashikala J. Shetty and Meera T. Shetty, the High Court Judge Satyanarayana had passed the order on July 30, 2014, directing the Home Secretary to keep SP Dr Sharanappa, Beltangady Circle inspector Lingappa Poojary and station house officer (assistant sup-inspector) of Betangady police station Babu Gowda under suspension till charge-sheet was filed in a land-grab case by the petitioners.
The duo had complained that their land was illegally occupied while building Shree Kshetra Kunjarpa temple in Ujire. The dispute had begun after Hindutva activist and Praja Prabhutva Vedike leader Mahesh Thimarody took over as the chief of temple committee after the demise of Shashikala Shetty's father Mahabala Shetty.
According to the complainants the temple, the land on which the temple was constructed was belonged to them. The subsequent survey report also had endorsed the complainants' claim.
Later, Shashikala Shetty filed a petition in the high court alleging that the Beltangady police of failing to take necessary action in connection with the case. The high court had summoned the SP and other police officials in July. However trio failed to appear in the court. This made the judge to direct the home department to suspend the cops.
Following this Dr Sharanappa secured permission of the State government and filed a petition before the Supreme Court. Another petition was filed by Mr. Lingappa. The Supreme Court on September 26 had stayed the High Court order.
The SP said the complaint with the Belthangady police filed by Shashikala and Meera against Mahesh Shetty Thimrody accusing him of trespassing on their land in Ujire had been transferred to the Mangaluru Police Commissionerate.
