The petitioner Suresh Bhat Bhakrabail, president of Komu Souharda Vedike, Dakshina Kannada district, has moved the High Court, stating that despite an FIR being filed against Bhat, he has not been arrested by the police.
He submitted that even the recent attack on women at a homestay in Mangalore was instigated by him.
The division bench comprising Chief Justice Vikramajit Sen and Justice Aravind Kumar has ordered notice to the government, home ministry and Mr Bhat.
It could be recalled here Mr Bhat's speech during a Hindu Samajotsav on January 22, 2012, had led to communal violence in the town of Uppinagady and surrounding areas. Mr Bhat had also threatened to attack and shoot down the Muslim youths. Though police had filed an FIR against Mr Bhat no action was taken against him.
